Regarding Elder Law I believe? Not certain

My Mom sold her home, her only source of $$$$ and stability w/the help of my brother and it was sold dirt cheap. (for his convenience, not hers, he had bills to pay off and needed $$$). Anyway, she moved into kind of a retirement community by herself, began having medical problems & was told she couldn't live alone anymore. Instead of taking her home w/him, my Brother signed her into a Private, VERYH expensive Assisted living facility which costs almost 2K per month KNOWING this would eat up her savings and it quickly did so. She began asking him for financial info but her never produced it, I took her to visit an attorney and she filed suit against him. The ALF keeps hounding me to pick her up even tho I have nowhere for her to live. Can they do anything to me if I have never signed anything saying I'd be responsible for her? They've even called DHR to check on any abuse and all I've done is try to help her when she ASKED me to, and nothing more. I don't have anything for myself and live w/another family member, I don't have a home for her to live in or I'd gladly go get her. I don't want her homeless so what is the quickest thing to do to find her housing and the legal thing to do to keep myself clear from law enforcement

Guardianship of an incapacitated parent.

I have a question regarding the limits to guardianship. My mother was declared incompetent, and my sister petitioned for guardianship. Which she received last month. The guardianship was not contested as we felt my sister would make decisions that would benefit my mother; however, that has not been the case. My mother has been residing with another sibling, since early March. My sister with guardianship has forced my mother to come to her house for the weekend. Telling my mother she would have the police forcibly remove her and bring her over, meanwhile arresting the sibling who is caring for her. She is leaving my mother alone at night with a 12 year old. Now that an assisted living facility can not be found, my sister (guardian) is planning on forcing my mother to move into her home. My mother is adamant this not happen due to the stress, and the fact that a spare bedroom is not available. Can my sister force her to live with her? Do the other 3 siblings have any recourse now?

During the guardianship hearing my mother had a court appointed lawyer, are they still her counsel?

Financial Crime against Elder Mother

My 92 mother year old died last year. Prior to her death a supposedly honest close friend of our family was what I believed, taking care of her daily necessities. I am the the sole surviving sibling and successor trustee to my mother's inter-vivos trust. The corpus of trust states that I am responsible for paying for her final funeral expenses and any other outstanding valid claims plus filing the estate, trust and her personal final tax returns, which I have accomplished. When I started to take inventory of her finanancial, real property and tangible personal property assets, I discovered that there were two life insurance policies that insured my mother's life that initially named me as her beneficiary and one other that designated my granddaugther as her beneficiary. When I called the life insurance company's claims department to file a claim, I was told that the policies were surrendered to the life insurance company four years ago. I wrote the insurance company asking for copies of the checks showing who the payee was. I received the information I requested and the payee's name was the supposedly honest close personal family friend. There is more apperent fid abuse but no more room to explain here. The police won't help.

Working and social security.

My mother, who is 83, collects social security. She recently began writing free lance articles for a local newspaper and is being paid for her articles. How much money can she make before it has any bearing on her social security payments?

Power of Attorney Obligations for Debt

If I assume power of attorney for a sickly, elderly parent, do I also assume liability for debts that are owed or that are possibly in default? If so, can I seek protections under bankruptcy law without having an adverse impact on my own credit standing?

Guardianship over elder

My father is in his late 70's, and has been displaying progressively worse signs of dimentia. His Dr's office called me to discuss, and set up some ''in-home'' visits by local elder council to determine living conditions. My father has taken this as a personal attack by me to ''take over'' his life and estate. I have now been removed as Medical POA, and a shady relative has taken the opportunity to ''side'' against me with my father. The relative has now been named medical POA, my father yells and hangs up when I call and I wasn't even the one that set the visits up!

I found out when I called his Dr. that He's instructed his Dr to no longer talk to me. Then the Dr tells me I should get an attorney which seemed a strange thing to say. Is there anything I can do about this situation? I dont' want my dad to be taken advantage of, and he's threatening to change his will to completely cut me out, anything I can do?

legal rights

My mother in law lives in Indiana my husband and I live in Arkansas. We need to know what our legal rights would be to bring her to live in Ar. with us. Her younger son said he has power of attorney, but we are not sure. He has placed her into a nursing home. this is why we want her to live with us. He has been taking care of by paying bills and other things, but we just found out he hasn't paid her house payment in 2 months. She has also lived with out water for over 30 days while in his care. He does not live with her. She lives in her own house. Afetre he husband past away is when he being the closest to her started taking care of her. I really need to know what our legal rights are and what we can do about bringing her to live with us.

Elder Care

I have an Aunt in a nursing home and her daughter is Power of Attorney. My Aunt is a cancer patient, colse to death and in pain. Her daughter has decided to allow her to suffer without the aid of any pain meds. The doctors have tried to talk sense to her, yet she only wants her mother to suffer without pain meds or any visitors. It is her daughters way of getting even for what she believes was a bad childhood. The nursing home obviously has to abide by her wishes, although they know she is just doing this for revenge. She threatens law suits if they allow any visitors or if they administer any meds to make her comfortable. Is there any way we can over ride the POA and at least get my Aunt some pain relief from this extreme and painful cancer she has? They punish people for cruelty to animals, yet she is getting away with a legal form of torture. Please advise.

My husband recently went into the hospital. He only has Medicare...We live with my mother because she is old and blind. My name is on all her investments and property! Can the hospital take her money, if we cannot pay promptly?

i am named the sole administrator of my deceased fathers estate, i am his middle son , the will is being contested by my older bro and sis, the attorney who wrote the will appointed a lawyer for the estate. can this lawyer obtain my house during the probate process without my consent?

why would the initial attorney retained too handle 3 lawsuits hire an additional law firm for assistance. will not cost client any additional percentage upon completition of cases. hard to understand.

Can I Sue My Brother?

My question is I was given guardianship over my mother for her person and co-guardian (with a court appointed guardian) and I would like to sue my brother for stealing money from my brother over the last 4 years. He had POA for two of those years, but in the 4 years he NEVER had permission to pay his wife to come visit my mother. Do I have a chance of recovering that money? My mother has written him a letter last year asking for restitution of that money.

I now have guardianhip and also Power of Attorney.

I am 73 years old and have a SS cheek of $565.00 per mo. can child suport take $242.50 out : that is a little less then half,and it is under the poverity level?The irs garanchies ss cheek ,but the first $750 can't be counted,only monieys after that amount can be taped by 15%.I think that childsuport has over sept thier authority .and I want it stoped. can you all help. Having a parent declared incompetent

How do I go about having my 63 year old Father declared incompetent? He has declared bankruptcy and will lose both his car and his home. He had a major aschemic stroke about a month ago and is ready to be released from the rehabilitation hospital. He needs 24 hour care as his left side is paralyzed. His mind seems okay until he starts talking about going home. This is impossible. What do I do in this situation. I can only do a certain amount to help him and feel he needs to be in a home of some kind where he can get the care he needs. He does not agree. What do I do? I am the ex-wife asking this quextion on behalf of my son who works long hours and asked me to help him out in finding information on this. Thank you for your assistance.

Caregiver

I live in Florida. My mother is deceased. My father has diabetes and a

heart condition. My father got re-married and was married for 1 and a

half years before he died. Now our step-mother says we have to pay her

for giving care to our father while they were married and says there is

a law in Florida that says we have to. Is there such a law in Florida

that says the children must pay the stepmother as a caretaker to our

father while he was alive? If so, can you point me in the direction to

read this law?

Brother transfered title to himself.

After loosing our home in Sept. we went to stay with my mother. She is 78. In December my brother sent a letter to us telling us to vacate the property 10 days before X-mas. He then informed us that mother had Alzhimers and that he had durable power of attorney, and that he was now the legal owner of the property and we had to leave. Mother does not have Alzhimers, and she was not aware that her property had been transfered out of her name. Now we have been issued a notice of termination of tenacy, that has our names and ''all others in possession of the premises''. Can he legallly do this to us and his mother? Is the paperwork valid with the clause ''all others'' it does not preclude the mother so would it mean her also? She does not want us to go and told us to hire an attorney.
