My mother, who is 64, lives alone in a single family house in Pensacola, Florida. I live in Los Angeles, California. Besides each other, neither of us as has any immediate surviving family. In my judgement, she should not be allowed to continue in charge of her own affairs, as she is a compulsive hoarder, becomes overdrawn on her bank account every month and has attempted suicide within the last four years (and held by the Baker Act for at least several weeks in a mental health facility), among many other sad behaviors. These behaviors have resulted in her having a car she cannot drive because it is not registered or insured, failure to have prescribed medicines due to lack of funds, and my having to pay her utilities occasionally to prevent them being shut off. How would I go about having her declared incompetent to handle her own affairs and, if I am placed in charge of them, can I ''force'' her to move to California so I can help her look after herself either by sharing a residence with me or placing her in a private apartment I would provide?

My mother moved into our home when she required extensive 24/7 care. I had to stay home to care for her, take her to all medical appts, hospitals, etc. I bathed her, cooked for her, did therapy, etc. My husband helped, too. She promised to pay room and board and pay for my services. After a year, she snuck out without paying. When I spoke to her about it she told me to get it out of her estate when she died. She promised me we'd get paid out of the estate. Can I send her a bill and hope to at least get paid out of her estate when she passes? She is not a nice woman; in fact, she's downright mean, manipulative and cruel. Still we cared for her with love, hoping to make her happy. She just used us and moved on when she was well.

Do we have a chance to collect from her estate when the time comes? Should I send a bill to her certified in the mail? (P.S.S. I am a professional in the health care industry.)

LIfe Estate Deed

My husband and sister-in-law were deeded their parents house in 1998. It was sold to them for $1.00, but with a life estate for their parents. My father-in-law passed away in August and my mother-in-law has since been put into a nursing home. She is on medicare/mass health and is being fully covered for the nursing home expenses at this time as she does not own the house. My husband has power of atty for his mother.

We now want to sell the house since she is no longer living in the house. We were told that medicare may have a stake in the house because of the life estate, is this true? My sister in law is fighting us and supposedly checked with a lawyer and said that they would get 52% of the sale of the house. The transfer of deed was over 10 years ago and my mother in law is incapable of ever returning to the home.
