The Issue Whether the Respondent's license to practice nursing should be disciplined based upon the allegations that Respondent was guilty of unprofessional conduct, in violation of Section 464.018(1)(h),Florida Statutes.
Findings Of Fact Department of Health (Petitioner) is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Chapters 20, 120, 455 and 464, Florida Statutes, and the rules promulgated pursuant thereto. Bonnie Fay Baker Palmer (Respondent), is now and was at all times material hereto a Licensed Practical Nurse (L.P.N.) in the State of Florida having been issued license no. PN 0448611 in accordance with Chapter 464, Florida Statutes. Respondent was employed at Imperial Village Care Center as a L.P.N. for approximately three and one-half years prior to February 21, 1996. Sometime in December 1995 or January 1996, while working the day shift as the floor nurse on Canterbury Hall of the Care Center, Respondent was assigned to care for patient, G. C. Patient, G. C., was an elderly patient who suffered from dementia and other ailments and was not ambulatory. G. C. had contractions of her left leg and left arm and any movement of those extremities caused her pain. G. C. was transported in a wheelchair and screamed, kicked, yelled, hit,and pinched anyone who tried to move her or give her treatment. On the date of the alleged incident, Respondent was ordered to medicate G. C., because she suffered from decubites (bed sores) on the heel of her foot. Respondent was assisted by a C.N.A. who picked up G. C. and placed her on her bed. G. C. became very agitated and began to scream, yell, scratch, hit and pinch Respondent and the C.N.A. Respondent attempted to apply medication to the affected area. While doing so, Respondent wore a protective mitten, used to protect staff from aggressive patients. During this time, the mitten was seen by the C.N.A. in the patient's mouth. The testimony is unclear if Respondent was wiping the saliva from patient's mouth with it, or if Respondent stuffed it in her mouth. The hearsay statement signed by Respondent, but prepared by the Director of Nursing, who did not testify, is not helpful in clarifying what happened. The statement was prepared approximately two months after the alleged incident by a person not present during the incident, and contained matters extraneous to this matter. Respondent has no prior criminal or disciplinary history and denies that she abused the patient in any way. No qualified testimony was offered to prove that Respondent failed to meet the minimum standard of acceptable nursing practice in the treatment of patient, G. C.
Recommendation Based on the foregoing, it is RECOMMENDED that the Board of Nursing find the Respondent not guilty of the charge in the Administrative Complaint, dated September 20, 1996, and that the Administrative Complaint be dismissed. Findings Of Fact Petitioner became a Registered Nurse in 1965 and has been engaged in the nursing profession since that time. She was awarded a Bachelor of Science in nursing in 1975 from Florida International University and is presently enrolled in the masters of nursing degree program at the University of Miami. In 1973 Petitioner enrolled in the Primary Care Nurse Practitioner program at the University of Miami and successfully completed the six months program in December 1973. During this program she received 1,000 hours training. Upon completion of this training, Petitioner was eligible for licensure as an Advanced Nurse Practitioner but did not apply for registration at that time although she worked as a Nurse Practitioner immediately upon completion of the training. From January 1974 to March 1977 Petitioner worked at Jackson Memorial Hospital at Miami as an Advanced Family Nurse Practitioner. During this period she received actual instruction of approximately one hour per day for a total of some 710 hours in duties of Nurse Practitioner in addition to the daily experience gained working as a Nurse Practitioner. In 1977 Petitioner moved to Colorado where she worked as a Nurse Practitioner from October 1977 until April 1978 for the Rocky Mountain Planned Parenthood organization and the Mountain Community Medical Clinic. In the latter position she manned a clinic that was some 30 to 40 miles from the nearest doctor and communicated with the doctor by telephone in diagnosing and treating patients. She worked some 348 hours in this position. Additionally, Petitioner taught in the Nurse Practitioner program at the University of Colorado one to three days per week from January until May 1978. Upon Petitioner's return to Florida in May 1978 she applied for licensure as an Advanced Nurse Practitioner and was denied licensure because the regulations were changed effective March 31, 1978, to require a one-year educational training program in lieu of the six months program completed by Petitioner. The current approved program at the University of Miami provides some 1,105 hours of training similar to the training Petitioner obtained at the earlier course.
Findings Of Fact Respondent, Jean L. Hammer, was at all times material hereto a licensed practical nurse in the State of Florida, having been issued license number 0588011. In October 1986, respondent was employed by Pinewood Lodge, a treatment center for alcohol and drug rehabilitation, as a staff nurse on the midnight to 8:00 a.m. shift. Respondent was the only employee on duty during her shift, and was responsible for monitoring the patients for signs of distress, noting their progress on the medical records, and administering prescribed medications. For such services, respondent was paid $27,000 per annum; a salary consistent with that paid a registered nurse (R.N.) at the facility. In January 1987, respondent was offered and accepted the position of Supervisor of Nurses at Pinewood Lodge. The staffing of this position required the services of and provided an annual salary of $25,000 and other benefits. Respondent occupied this position until July 1987 when it was discovered that she was not a registered nurse and was discharged. The respondent's personnel file at Pinewood Lodge demonstrates that in seeking and gaining employment at the facility respondent represented herself to be a licensed registered nurse, the recipient of a Bachelor of Science degree from the University of Pittsburgh, and the recipient of an Associate in Science Nursing degree from Broward Community College. Such representations were false, and the documents submitted to support such representations were forgeries. The proof further demonstrates that respondent assumed the title of R.N., routinely signed documents in a manner that identified her as an R.N., and otherwise led the public and associates to believe that she was licensed as a registered nurse; all for pecuniary gain. While there was no showing that anything untoward occurred during the course of her tenure at Pinewood Lodge, respondent knew her actions were improper.
Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED that a final order be entered suspending respondent's license for one year, that following such suspension respondent be placed on probation for two years subject to such terms and conditions as the board may specify, and imposing an administrative fine against respondent in the sum of $1,000. Findings Of Fact Based on the admissions of the parties, on the exhibits received in evidence and on the testimony of the witnesses at the hearing, I make the following findings of fact. Respondent, Kimberly Bauzon, L.P.N., is a licensed practical nurse in the state of Florida, having been issued license number PN 0803361. Respondent has been so licensed at all times material to the allegations in the complaint. Between the dates of October 25, 1985, and December 2, 1985, the Respondent was employed as an LPN by the Care Unit of Jacksonville Beach. On various occasions during her employment as an LPN at the Care Unit of Jacksonville Beach, Respondent charted vital signs for patients that she had not, in fact, taken. On or about November 21, 1985, while employed as an LPN on duty at the Care Unit of Jacksonville Beach, without authority or authorization, Respondent left her unit within the Care Unit for at least thirty (30) minutes. During that period of at least thirty (30) minutes on November 21, 1985, during which Respondent was out of her unit, there was no nurse present in the unit to take care of patient needs. Also on or about November 21, 1985, while on duty at the Care Unit of Jacksonville Beach, Respondent was asleep for a period of at least two (2) hours. On one occasion during Respondent's employment at the Care Unit of Jacksonville Beach, Respondent pulled a male adolescent by the waistband at the front of his trousers in the course of directing the patient to provide a urine specimen. The manner in which Respondent pulled on the patient's clothing was inappropriate and unprofessional. It is unprofessional conduct and a departure from minimal standards of acceptable and prevailing nursing practice for an LPN to be asleep while on duty. It is unprofessional conduct and a departure from minimal standards of acceptable and prevailing nursing practice for an LPN to chart vital signs which she has not, in fact, taken. It is unprofessional conduct and a departure from minimal standards of acceptable and prevailing nursing practice for an LPN to leave her unit for a period of thirty (30) minutes in the absence of a replacement nurse.
Recommendation In view of all of the foregoing, it is recommended that the Board of Nursing enter a final order in this case finding the Respondent guilty of one incident of violation of Section 464.018(1)(d), Florida Statutes, and four incidents of violation of Section 464.018(1)(f), Florida Statutes. And in view of the provisions of Rule 210-10.05(4)(d), Florida Administrative Code, it is recommended that the Board of Nursing impose a penalty consisting of a letter of reprimand and further consisting of a requirement that Respondent attend required specific continuing education courses, with an emphasis on the legal responsibilities of a nurse to the patients under her care. Findings Of Fact The Respondent is a licensed practical nurse holding license number 0688681. At all times pertinent to this proceeding the Respondent was employed as a licensed practical nurse at Leesburg Center Health Care and Nursing Home. The Petitioner is an agency of the state of Florida charged with enforcing the professional practice standards for nurses embodied in Chapter 464, Florida Statutes (1981) and with initiating and prosecuting disciplinary actions against nurses for violations of those standards. On February 7, 1983, the Respondent while working as a nurse or medical technician at the Sumter Correctional Institute was involved in a disturbance with some inmates in the course of which the chemical "mace" was used to quell the disturbance. Later that evening at approximately eleven p.m. he reported for his night shift duty at Leesburg Center Health Care and Nursing Home complaining of a migraine headache. His supervisor, Nurse Cavatello informed him that he could lie down and get some sleep during his "break." During breaktimes, nurses are considered to be "off-duty". Such was the policy at that time at Leesburg Center Health Care and Nursing Home. During his breaktime, while on duty early on the morning of February 8, 1983, at approximately 2:00 a.m., Respondent was asleep on a stretcher some ten to twelve feet from his duty station while on his break. At that time he was observed by Nursing Director, Shirley Gooden, to be asleep and she awakened him. She inquired as to why he was sleeping on duty and he informed her that he was on his break. Nurse Gooden informed the Respondent that he was not considered to be "on break" because he had not "punched out" on a time clock or card before going on his break as required by the employer's nurses handbook, therefore she immediately terminated him from employment. It was accepted policy and practice at that facility for nurses to be able to sleep while on break, especially on late-night shifts such as the Respondent was employed on, on the night in question. It was also the accepted policy and practice that nurses did not have to "clock in or out" when they were merely taking their authorized breaktime as the Respondent was doing. The Respondent's immediate supervisor, Nurse Cavatello, authorized him to sleep during his breaktime and did not require him to "punch out" or make a formal record of his breaktime on the evening in question. Thus, the Respondent, who was admittedly asleep at the time in question, was not on duty, but rather was on his breaktime, during which he was permitted by his supervisor to sleep. On January 1, 1983, the Respondent submitted his employment application for the position of Licensed Practical Nurse at Leesburg Center Health Care and Nursing Home. On that employment application he indicated that he left his last employment as a deputy sheriff for Polk County for the reason that he wished to return to school to further his education. In reality, the Respondent was terminated from his position as deputy sheriff by the Polk County Sheriff's Department for falsifying an official department record, and for "conduct unbecoming an employee" of the Sheriff's Department. This is the first occasion in which the Respondent has been subjected to disciplinary action with regard to his licensure status by the Petitioner. His record as a licensed practical nurse is otherwise unblemished and he displays a high level of skill and compassion in his nursing duties and in his relations with patients while performing those duties.
Recommendation Having considered the foregoing Findings of Fact and Conclusions of Law, the evidence of record, and the candor and demeanor of the witnesses, it is, therefore RECOMMENDED: That a Final Order be entered by the Board of Nursing issuing a formal reprimand to the Respondent, Richard Womack, imposing a period of probation on his licensure status until such time as he completes a continuing education course in the legal aspects of nursing. The Issue Whether Respondent engaged in unprofessional conduct and, if so, what penalty should be imposed on his nursing license.
Findings Of Fact The Department of Health is the state agency charged with regulating the practice of nursing pursuant to Chapter 464, Florida Statutes. Respondent, Cecil Harold Floyd, was at all times material hereto a licensed practical nurse in the State of Florida, having been issued a license numbered PN 0960631. At all times material hereto, Respondent was employed as a licensed practical nurse by the North Shore Senior Adult Community in St. Petersburg, Florida. At all times material hereto, Respondent was assigned to care for Patient M.F., a patient in the skilled nursing section of the North Shore Senior Adult Community. On February 26-27, 1996, Respondent worked as the charge nurse on the 11:00 p.m. to 7:00 a.m. shift. On February 27, 1996, at approximately 6:00 a.m., Respondent wrote in the nurse's notes that Patient M.F. was lethargic and having difficulty swallowing; that the patient's bottom dentures were out; and that the patient's tongue was over to the right side. In this entry, Respondent also noted "will continue to monitor." After Respondent completed his shift on February 27, 1996, Conchita McClory, LPN, was the charge nurse in the skilled nursing facility at North Shore Senior Adult Community. At about 8:10 a.m., Nurse McClory was called by the CNA who was attempting to wake up Patient M.F. Upon Nurse McClory's entering Patient M.F.'s room, she observed that the patient was sleeping, incontinent, and restless and that the right side of the patient's face was dropping. Based on these observations, Nurse McClory believed that Patient M.F. may have suffered a stroke and she immediately called 911. Following the 911 call, Patent M.F. was taken to Saint Anthony's Hospital in Saint Petersburg, Florida. Prior to coming to this country, Conchita McClory had been trained and worked as a registered nurse in the Philippines. However, Ms. McClory is not licensed as a registered nurse in the State of Florida. Saint Anthony's Hospital's records regarding Patient M.F. indicate that the patient had a history of multiple strokes beginning in 1986. The Department’s Administrative Complaint against Respondent included the following factual allegations, all of which were alleged to have occurred on February 27, 1996: At approximately 6:00 a.m., Respondent recorded in the nurse’s notes that Patient M.F. was lethargic and having difficulty swallowing; the patient's bottom dentures were out; and the patient's tongue was over to the right side. Respondent also noted in the nurses' notes that Patient M.F. should continue to be monitored. Patient M.F.'s roommate told Respondent that she believed that M.F. had suffered a stroke because she could not swallow and her speech was slurred. At about 8:00 a.m., Patient M.F.'s roommate went to the nurses' station and requested that a certified nurse's assistant check on M.F. Patient M.F. was found paralyzed on her left side, soaked in urine and unable to speak. There was no evidence presented to support the factual allegations referenced in paragraph 9b and 9c above and included in the Administrative Complaint.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Department of Health, Board of Nursing, enter a final order dismissing the Administrative Complaint against Respondent. The Issue This case concerns the issue of whether the Respondent's license as a registered nurse should be suspended, revoked or otherwise disciplined for submitting employment applications which contained false information and for unprofessional conduct in the performance of her duties as a nurse. At the formal hearing the Petitioner called as witnesses Janet Brown, Wilma Green, E. Jean King, Susan Coffin Brennan, Mary Ann Cottrell, and Mary Sheffield. The Respondent testified on her own behalf and was the only witness called by the Respondent. The Petitioner offered and had admitted into evidence, ten exhibits and the Respondent offered and had admitted into evidence, seven exhibits. Counsel for the Petitioner and counsel for the Respondent submitted proposed findings of fact and conclusions of law for consideration by the Hearing Officer. To the extent that those proposed findings of fact and conclusions of law are consistent with the findings made in this order, the proposed findings were adopted by the Hearing Officer. To the extent that the proposed findings and conclusions of law are not consistent with this order, they were considered by the Hearing Officer and rejected as being unsupported by the evidence or unnecessary to the resolution of this cause.
Findings Of Fact The facts set-forth in paragraphs 1 through 4 below were stipulated to by the parties and are found as facts: At all times pertinent to this proceeding, Respondent was a licensed registered nurse in the State of Florida, having been issued license number 67142-2. Respondent filled out and filed the applications for licensure as a registered nurse, Petitioner's Exhibit No. 1. Respondent did fill out and file the applications for employment as a nurse, Petitioner's Exhibit Nos. 2 through 9. Respondent did falsify her date of birth, age, and date of graduation from nursing school on her applications for employment as a nurse, Petitioner's Exhibit Nos. 2 through 9. This was done by Respondent on the recommendation of an employment agency initially, and was done in order to obtain employment. On or about April 8, 1982, Respondent filled out and submitted an employment application for work as a nurse to Lakeview Nursing Center. (Petitioner s Exhibit No. 2). The application reflected that Respondent obtained her R.N. degree from Bellevue Hospital in 1948. That information is false. The Respondent received her R.N. degree in 1939. On or about March 11, 1983, Respondent filled out and submitted an employment application for work as a nurse to Leesburg General Hospital, Leesburg, Florida (Petitioner's Exhibit No. 3). That application reflects a date of birth of December 24, 1932 and the date June, 1948 as the year Respondent received her nursing degree. This information is false in that Respondent's date of birth is September 29, 1918, and the year she received her nursing degree was June, 1939. On or about January 25, 1982, Respondent filled out and submitted an application for employment as a registered nurse to Sanford Nursing and Convalescent Center, Inc., Sanford, Florida (Petitioner's Exhibit No. 4). That application reflected a date of birth of December 24, 1932 and the year 1948 as the year in which Respondent obtained her R.N. degree. The date of birth and year of graduation are false. On or about May 28, 1980, Respondent filled out and submitted an application for employment as Director of Nursing at Orlando Memorial Convalescent Center, Orlando, Florida (Petitioner's Exhibit No. 5). That application reflected that Respondent graduated from Bellevue Hospital School of Nursing in 1948. That information is false in that she graduated in 1939. On or about February 13, 1980, the Respondent filled out and submitted an application for employment as a nurse to Quality Care, a nursing service (Petitioner's Exhibit No. 6). That application contained a false date of birth of December 24, 1932 and a false year of graduation from Bellevue Hospital School of Nursing of 1948. On or about January 23, 1980, Respondent filled out and submitted to the Physician's Registry an application for employment as a nurse (Petitioner's Exhibit No. 7). That application reflected an age of 47 and date of birth of January 24, 1932. This information is false. On or about January 8, 1980, the Respondent filled out and submitted an application for employment as a nurse to Medox, Inc. That information reflected a birth date of December 24, 1932 and a year of graduation from Bellevue Hospital as 1948 (Petitioner's Exhibit No. 8). This birthdate and year of graduation are false. On or about January 19, 1978, Respondent filled out and submitted an application for employment as a nurse to Dr. P. Phillips Memorial Nursing Home, Orlando, Florida (Petitioner's Exhibit No. 9). That application reflected an incorrect birthdate of December 24, 1932 and reflected that Respondent attended Bellevue Hospital School of Nursing from 1945 to 1948. Respondent actually attended Bellevue Hospital from 1936 to 1939. During March, 1982, Respondent was employed as a registered nurse at Leesburg Regional Medical Center. Janet Gillespie Brown, also a registered nurse, was assigned to act as Respondent's preceptor during Respondent's orientation at Leesburg Regional Medical Center. As her preceptor Ms. Brown trained as well as supervised Respondent's work during her orientation period. During the time she was employed at Leesburg Regional Medical Center, the Respondent used improper procedures in attempting to insert a foley catheter into a female patient. in cleansing the meatus to remove bacteria the Respondent used a scrubbing technique rather than a wiping technique. This was improper antiseptic technique. The Respondent then attempted to insert the catheter by probing. This also was improper. Upon observing these improper techniques Janet Brown instructed Respondent to make no further attempts to insert the catheter and told her to wait whale she obtained a sterile foley kit which she would insert herself. Respondent did not do as she had been instructed and inserted the catheter after Nurse Brown left the patient's room to obtain the sterile foley kit. After Nurse Brown returned and discovered the catheter had been inserted against her instructions, she went outside the patient's room with Respondent and explained to her that the catheter she inserted was contaminated as a result of the probing. Respondent agreed and explained that she had not performed this procedure for awhile. The ability to properly insert such catheters is a basic nursing skill. No infection resulted from the improper insertion of the catheter by Respondent. Also while employed at Leesburg Regional Medical Center the Respondent failed to properly chart food intake of patients in that she charted each item of food consumed rather than charting percentages of food consumed as she had been instructed. Respondent also failed to properly chart the progress of a stroke patient by failing to chart that the patient had been making attempts to verbally communicate. The Respondent failed to properly organize her time, appeared unable to properly assess patient progress by asking appropriate questions and recording the patient's response, and failed to complete daily assignments such as bed baths and picking up food trays. Respondent did not feel capable of starting an IV (intravenous). Although starting an IV was not considered to be a skill required of Respondent by Leesburg Regional Medical Center, Respondent was unable to change the tubing on an IV and this was a skill expected of her. Respondent was also unable to give accurate counts of the remaining amount of solution in patients' IVs. On one occasion Respondent failed to properly chart the time of the doctor's visit and apparently "switched" the time. Respondent increased the IV flow for a patient as requested by the doctor, but charted the doctor's visit as having occurred later than the time at which she increased the IV. While working at Leesburg Regional Medical Center the Respondent failed to meet the minimal standards of acceptable and prevailing nursing practice. During the first part of February, 1982, Respondent was employed as a relief charge nurse at Sanford Nursing and Convalescent Center, Sanford, Florida. Ms. E. Jean King, R.N. was a charge nurse at Sanford Nursing and Convalescent Center and was assigned to assist in Respondent's orientation. While at Sanford Nursing and Convalescent Center, Respondent was observed by Ms. King to be very confused and very disorganized in her work. She could not remember patients' names and in passing out medications failed to medicate some patients. Then asked whether or not a particular patient had been given medication, Respondent became confused and indicated she could not remember whether or not the medication had been given. In taking a phone order from a doctor the Respondent wrote the wrong order on a sheet of paper and could not then remember what medication had in fact been ordered. This necessitated calling the doctor back and having the order repeated. Respondent also administered medications without first taking the pulse and blood pressure of the patient as required. Respondent required much more supervision than the other nurses under Ms. King's supervision. Respondent's performance and nursing practice at Sanford Nursing and Convalescent Center failed to meet the minimal standards of acceptable and prevailing nursing practice in Florida. On January 12 and January 27, 1980, Respondent as an employee of Medox, Inc., was assigned to Florida Hospital in Orlando, Florida. At the time she reported for work Respondent was informed by Ms. Ann Cottrell, R.N. (Head Nurse in Special Care at Florida Hospital) about what her responsibilities would be during her shift as team leader in the progressive care unit. The duties outlined to Respondent included responsibility for the administration of IV medications, antiequivalent drugs, insulin and any other specific procedures not within the job description of the licensed practical nurses. Respondent was also instructed that she was responsible for ordering IV medications that were to be administered for the next twenty-four (24) hours, that she was to make rounds with the physicians and observe and report the patients' conditions, and that at the end of the shift she was responsible for making certain that all charts were signed off, the doctor's orders were signed off, and any pertinent information included in the nurse's notes. During the course of the day Ms. Cottrell checked back with Respondent several times and asked if she understood her responsibilities and whether she was having any problems. Each time Respondent indicated that she knew what she was doing and had done it many times. During the course of the day the Respondent failed to make a complete report on the patients and as a result, the three to eleven shift was unable to determine what had happened during the day with regard to the patients for which Respondent was responsible. Medications had not been charted properly and many of the notes entered by Respondent were irrelevant to the patient's progress. Respondent also failed to insure that EKG strips for which she was responsible had been read. Ms. Cottrell, a registered nurse, was qualified to express an opinion as to the prevailing standards of nursing practice in Florida. She testified that in her opinion the Respondent was not qualified to work in an acute care area as a nurse and that her performance of her duties at Florida Hospital failed to meet the minimal standards of acceptable nursing practice in the State of Florida. This opinion is accepted by the Hearing Officer.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the Respondent's license as a registered nurse be suspended for a period of three (3) months. It is further RECOMMENDED that upon completion of the three-month suspension period, Respondent be placed on probation for a period of one (1) year working only under the supervision of another licensed nurse and upon such other conditions as the Board may specify. Findings Of Fact Respondent, Barbara Jiminez, is a licensed practical nurse (LPN) in the State of Florida, having been issued license number PN 0812181. At the time of the incident involved in this case, Respondent was a LPN. In 1987, Respondent was employed as a licensed practical nurse by Holly Point Manor, a nursing home located in Orange Park, Florida. Respondent was also employed as a LPN by another nursing home in the area. She was scheduled to work the 3:00 p.m. to 11:00 p.m. shift at Holly Point Manor. Holly Point Manor was a new facility and had opened in November, 1987. Only one wing of the facility was open and in December, 1987, Holly Point Manor serviced approximately 50 patients. On December 21, 1987, Respondent presented a letter of resignation to Tom Burrell, Director of Nursing at Holly Point Manor. The resignation was effective December 20, 1987. The resignation was precipitated by a verbal altercation with Liz McClain, a certified nursing assistant (CNA) at Holly Point Manor. The verbal exchange occurred on December 20, 1987. However, difficulties between Respondent and Ms. McClain had been brewing for a period of time prior to the verbal exchange of the 20th. After discussing the letter with Burrell, Respondent agreed to work on an as-needed basis at the facility. Burrell indicated that he needed Respondent to work until the beginning of the year, and therefore scheduled the Respondent for the remainder of December. Respondent was scheduled to work her usual shift on December 23, 24, and 25, 1987. She was scheduled to work with Virginia Anderson. Ms. Anderson is also a LPN. On December 23, 1987, Respondent clocked in for work at approximately 2:40 p.m. EST and clocked out the same day at 3:40 p.m. EST. On December 23, 1987, the Respondent and Virginia Anderson began work before the 3:00 p.m. change-of-shift. At shift change, both nurses went into the medication room to "take report" from Nurse Jan Sturgeon, the LPN who had worked the previous shift. A "report" at the change of shift consists of the previous shift's nurse going down the list of each resident/patient and reporting each patient's respective condition to the on-coming nurse. Part of the report includes counting the medications on the medication cart to ensure a correct count in the narcotic drawer of each cart. In this case, there were two medication carts, one for each of the on-coming nurses. These carts are locked and the nurse responsible for the cart maintains possession of the keys to that cart. Ms. Sturgeon "reported off" first to Ms. Anderson, and then to Respondent. Ms. Anderson began her rounds after receiving a report and keys to her cart from Ms. Sturgeon. Subsequently, Respondent received a report and keys to her cart from Ms. Sturgeon. At some time during Respondent's clocking in and taking report, a problem arose over the staffing assignments of the C.N.A.'s. Respondent was the nurse responsible for making the CNA assignments. However, Nurse Anderson had already created patient-care assignments for the CNAs after one C.N.A. had failed to report for work.1/ The Respondent was not satisfied with the assignments created by Anderson and either requested that they be changed or changed them herself. The request or change immediately caused a bad atmosphere between the employees on the wing. Around 3:30 p.m., Respondent telephoned Tom Burrell. Respondent told Burre11 that she couldn't take it anymore and that she was leaving. Burrell told Respondent that she was scheduled to work and if she left she would be reported for what was, in his opinion, a violation of the Nurse Practice Act. Burrell did not give Respondent permission to leave. Either before or after the call to Burrell, Nurse Eppert, the Assistant Director of Nursing, told the Respondent that in her opinion there was nothing wrong with the C.N.A. assignments. Respondent stated, "Here's my keys - - I'm leaving." Eppert informed Respondent that she had no replacement nurse and did not want her to leave. Respondent pointed out that Ms. Sturgeon was still present. Eppert reminded Respondent that Sturgeon was off duty. Eppert then told Respondent to give a report to Nurse Anderson. She refused and told Ms. Anderson to get the report from Ms. Sturgeon who had just given the report to Respondent. Since Respondent had not begun her rounds, Ms. Sturgeon's report was still valid and the narcotic count had not changed. Respondent left Holly Point Manor. The Respondent did not positively know at the time she left whether Nurse Sturgeon would remain to assist. The Respondent did not stay to determine whether Sturgeon would, in fact, cover the shift. However, the evidence did show that Ms. Sturgeon tacitly agreed to stay before Respondent left the facility. Nurse Sturgeon was not the type of person to decline to help when the need arose. After the Respondent left, Jan Sturgeon formally agreed to stay to assist with the 5 p.m. medication pass. She agreed because Ms. Eppert could not find anyone to work due to the closeness of the holidays. After the medication pass, Ms. Sturgeon left for the evening and Ms. Anderson handled the shift by herself. One nurse working the night shift alone was not an unusual event at Holly Point and occurred frequently. In fact, Ms. Anderson had worked the previous evening's shift by herself. One nurse to 50 patients meets HRS staffing requirements for nursing home facilities. However, the hardest part of the evening shift for a solo nurse was the 5:00 p.m. medication pass. Later, the facility was able to retain a replacement nurse for the 24th and 25th. It is not an acceptable nursing practice for a nurse to leave his or her employment until that nurse is sure that somebody else is going to take care of the patients the nurse is responsible for. In this case, Respondent failed to positively ensure someone would replace her. Reliance on tacit agreement by either of the other two nurses is not enough. Likewise, past practice of the facility is not enough. Reliance on tacit agreement or past practice is too amorphous to insure protection and the safety of the patients the nurse is responsible for. However, tacit agreement and past practice do go towards mitigation of any disciplinary penalty in this case. Respondent's actions by not ensuring her replacement or at least the need for such a replacement constitutes unprofessional conduct in the practice of nursing Likewise, it is not an acceptable nursing practice for an LPN to leave without giving another nurse a report on patients that that nurse would be assuming and before counting the medications on the medication cart. However, in this case, the evidence demonstrated that a replacement was there whose earlier report was still accurate and valid. Therefore, formal patient reporting and narcotics counting was not necessary or required. 2/ Respondent is not subject to discipline under this standard.
Recommendation Based upon the foregoing Proposed Findings of Fact and Conclusions of Law, it is: RECOMMENDED that Petitioner enter a Final Order reprimanding the Respondent's license, and requiring her to take courses in the Legal Aspects of Nursing and in Stress Management within a 6 month time period. Findings Of Fact The Respondent, Joann Jensen, graduated from the University of Nebraska with the degree of Bachelor of Science in Nursing in 1972. She became licensed as a Registered Nurse in Florida, but upon moving back to the North she let the license lapse. When she returned to Florida in 1976 she was reinstated as a Registered Nurse, and she now holds license number 70429-2 issued by the Board of Nursing. Thereafter the Respondent became employed at Holy Cross Hospital in Fort Lauderdale on the 3:00 p.m. to 11:00 p.m. shift, and was assigned to the nursery where she became charge nurse in August of 1977. She held this position during the March-October, 1979, period which is involved in this proceeding. In October of 1979 the Respondent was transferred out of the nursery into a medical/surgical adult unit at Holy Cross Hospital, where she remained for about six months, when she left the hospital to work for a private nursing agency. Between March and October of 1979 the Respondent was observed by six nurses on several occasions when she continued to feed infants after they had begun to choke, gag and struggle for air. Specific occurrences were described with reference to infant's named Baby Mandell, Baby Saul, Baby Riccobono, Baby McDaniel, Baby Fast, Baby Davis, Baby Pierce, and Baby Fletch, although precise time frames were not uniformly established. Other instances were described generally without reference to any particular infant. The Respondent was further observed to have tube-fed an infant to the point where its abdomen became distended, to have forced liquid into an infant after it had been breast fed by the mother, and to have manipulated the nipple of a bottle in the mouth of an infant in a rough manner so as to increase the flow of fluid into the mouth. On at least one occasion an infant turned blue and required suction to clear its passages. This form of handling of infants by the Respondent continued from March of 1979 until October when she was transferred to an adult-care unit. The testimony of the six nurses presented by the Petitioner also establishes that the Respondent used what is known as the Crede Maneuver to induce newly circumcised infants to urinate. This is a procedure used by some nurses in which the bladder is massaged gently until urination occurs. However, the manner in which the Respondent performed this procedure was forceful and rough, resulting in painful screams from infants. On one occasion there was no stated medical reason for use of the Crede Maneuver on the infant except that the Respondent wanted to have the chart show that urination had occurred during her shift. The evidence further establishes that the Respondent cursed and used foul language in the nursery, and that in one instance this was directed at an infant when the mask used to protect its eyes under the bilirubin lights kept slipping off its face. Placing an infant under bilirubin lights with its eyes masked for protection is a procedure designed to break-down excessive bilirubin in the blood when this is a problem. Although the Complaint did not specifically allege that the Respondent's language in the nursery would be an issue, this evidence was received without objection, but has been accorded no weight by the Hearing Officer. The evidence presented by the Petitioner's expert witness establishes the fact that conduct such as described above, if true, is not acceptable nursing practice, and deviates from the minimum standards established for and prevailing in the nursing profession. Based upon the observed candor and demeanor of all the witnesses, the evidence presented by the Petitioner has been accorded sufficient weight to support the findings of fact set forth herein. No evidence was presented to show that these facts were in accordance with good nursing practice; thus, the evidence warrants a finding that the Respondent's conduct failed to conform to and departed from the standards of acceptable nursing practice. The testimony of the Respondent and her witnesses, and other evidence, amounted to a denial that the occurrences took place, that the Respondent was not working on at least one date when the conduct described was observed, that the charts and records do not corroborate the facts charged, and that the Petitioner's witnesses were engaged in a conspiracy against the Respondent. However, the testimony of the three nurses on behalf of the Respondent establishes no more than that they have not observed the conduct described by the other nurses. There was no corroborative testimony relative to a conspiracy among the Petitioner's witnesses. Further, the occurrences described took place over a prolonged time period, and involved numerous infants. There is no particular significance to the failure of the charts to contain notations confirming the observations of the nurses, or that the Respondent was not shown by the records to have been on duty the particular date of only one incident. The Respondent's former supervisor related one instance when a mother complained that the Respondent had been rough with her infant. An investigation resulted, from which she concluded that the Respondent might have been rough with the baby. This witness also thought there was some merit to the complaints that nurses made of the Respondent's treatment of infants, although she continued to give the Respondent good performance evaluations. In summary, there was not sufficient evidence presented by the Respondent to support her own self-serving denial and assertion of a conspiracy against her, or to effectively rebut the clear and convincing testimony presented in support of the allegations set forth in the Administrative Complaint.
Recommendation Based upon the foregoing findings of fact and conclusions of law, it is RECOMMENDED that license number 70429-2 authorizing the Respondent, Joann Jensen, to practice as a registered nurse, be revoked.
