The Issue Whether at the time of his father's death, Armando Martinez, Jr., was a "dependent beneficiary" of his father, a vested member of the Florida Retirement System, so as to be entitled to his father's retirement benefits?
Findings Of Fact Armando Martinez, Jr., was born on February 22, 1974, to Natalie M. Martinez and the late Armando Martinez, Sr. In 1992, when Armando, Jr., was eighteen years old, Mr. and Mrs. Martinez were divorced. The following year, 1993, less than two weeks after Armando, Jr.'s, nineteenth birthday, Armando Martinez, Sr., died. The cause of death was liver cancer, a disease from which Ms. Martinez presently suffers. At the time of his death on March 7, 1993, Mr. Martinez was a vested member of the Florida Retirement System. A municipal employee, he had been a bus operator. At some point close to commencement of his employment, slightly more than ten years prior to his death, Armando Martinez, Sr., had executed a Form M-10. The form named his wife, Natalie, as his primary beneficiary. Armando, Jr., the only child of Armando, Sr., and Natalie Martinez, was named as the sole contingency beneficiary. Following Mr. Martinez, Sr.'s death, Ms. Martinez disclaimed Florida Retirement System benefits. She did so in order for Armando, Jr., as the contingent beneficiary, to be able to receive the benefits. On February 17, 1997, the Division of Retirement denied Armando, Jr., survivor benefits. Had Mr. Martinez, Sr., died one-year and several weeks earlier, that is, prior to Armando, Jr.'s eighteenth birthday, the Division would have approved distribution of survivor benefits to him. But, although he was still a high school student, since he was older than nineteen by a few days at the time of his father's death, the Division required proof that Armando, Jr., had received half of his support from his father at the time of his father's death. No such proof was provided to the Division prior to or at the time of its preliminary denial. In fact, in his 1992 tax return, Mr. Martinez did not claim his son Armando, Jr., as a dependent. In this formal administrative proceeding, however, Armando Martinez, Jr., provided such proof, proof which was lacking until hearing. The year 1992 was very difficult for Armando Martinez, Jr., and his family. His parents separated, Armando, Jr., lived with his mother. Armando, Sr., lived elsewhere. Prior to his death, divorce proceedings were finalized. In the meantime, Ms. Martinez had lost her job. She remained unemployed for the entire year and in early 1993 as well. Armando, Jr., was still in high school at the time of his father's death. During the 1992-93 school year, to support himself and his mother, he obtained work part-time while he remained in school. Ms. Martinez paid the rent for their apartment at a rate of between $370 and $500 per month. The monthly phone bill of Ms. Martinez and Armando, Jr., was approximately $50; utility payments $70; groceries $300; gasoline $10, automobile insurance $100; and school supplies $40. There were other expenses, clothes, for example, that occurred from time-to-time. In addition to minimal government support to Ms. Martinez and Armando, Jr.'s, part-time employment income, Armando, Jr., was supported by cash payments provided by his father. Two or three times a month, Armando's father and a girl friend, Karen Jones, would drive to the front of the house. Because of his illness, Mr. Martinez remained in the car while Ms. Jones brought cash, usually between two and five hundred dollars in an envelope to the front door. On more than one of these occasions, Ms. Jones, the envelope, and the cash were observed by friends of the family at the moment of delivery. Ms. Martinez log of the estimates of these payments totals approximately $8,500, an amount in excess of Mr. Martinez's income reported in his 1992 tax return filed before his death in 1993 to be $6,389.00. But, Mr. Martinez, Sr. had access to other means of support and other monies including proceeds from insurance policies. The $8,500 provided to Armando, Jr., by Armando Martinez, Sr. constituted more than half of Armando, Jr.'s, support for the year 1992 and up until Mr. Martinez, Sr.'s, death in early 1993.
Recommendation Accordingly, it is hereby recommended that the Division of Retirement recognize Armando Martinez, Jr., to have been the dependent beneficiary of Armando Martinez, Sr., at the time of Mr. Martinez, Sr.'s, death, and therefore entitled to retirement benefits. The Issue May Petitioner make an application with Respondent for disability retirement benefits when he was already applied for and has received regular retirement payments?
Findings Of Fact Mr. Vernon Taylor Bell voluntarily terminated his employment with the Department of Legal Affairs on February 26, 1980. By that date he had accumulated 23.66 years of service for credit in the Florida Retirement System. After his termination Mr. Bell had a conference with a retirement benefits specialist, Ms. Taylor, who is an employee of Respondent. At Mr. Bell's request she gave him an estimate of his retirement benefits for a regular retirement. She did not discuss the benefits which a disabled retiree might receive. The testimony of Ms. Taylor and Mr. Bell is in conflict on whether or not she discussed disability retirement benefits with him. Ms. Taylor's testimony is accepted as being more credible because Mr. Bell was shown throughout his testimony to have a poor memory. Mr. Bell began to receive regular retirement benefits in the monthly amounts of $178.32 on May 30, 1980. Since that date he has continued to receive and accept regular retirement payments. Petitioner has cashed or deposited his first benefit check. If Mr. Bell were to be granted disability retirement benefits rather than regular retirement benefits, his monthly payment would be substantially increased. Petitioner did not present credible evidence that he was misinformed or mislead by Respondent about the relative advantages to him in electing to apply for regular retirement as opposed to applying for disability benefits. On August 26, 1980, Mr. Bell wrote a letter to Mr. Andrew M. McMullian III, who is the State Retirement Director. Mr. Bell stated that he had been given incorrect information about the disability benefits he might be eligible for. He requested that he be allowed to make an application as a disabled retiree. On October 1, 1980, Mr. McMullian responded to Mr. Bell in a letter which states in part: We have reviewed your retirement account and have determined the information provided to you by this office was correct regarding your retirement eligibility. We regret if there was any misunderstanding on your part re- garding disability retirement; however, we cannot honor your request to be retired with disability at this late date, because you applied for regular retirement which was approved for you effective April 1, 1980. Your initial monthly benefit was $178.32 and your July 1980 benefit payment contained a cost-of-living increase, thus your current monthly benefit is $179.73. The Florida Retirement System law requires certification by two licensed physicians in Florida that one is totally and permanently disabled and unable to render any useful and efficient work before this agency can approve an employee for retirement with disability. Apparently, you made no attempt to retire with disability, other than discussing the matter in general with us, and according to our records, you made no application for disability retirement. Further, a retiree is not allowed by law to change his type of re- tirement once he begins drawing monthly re- tirement benefits.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the State Retirement Director enter a Final Order authorizing Mr. Bell is submit an application for disability retirement benefits. The Issue The issue in this cause concerns whether the death of the Petitioner's husband arose out of and in the actual performance of duty required by his employment with the Florida Department of Transportation during regularly- scheduled working hours or irregular working hours, as required by his employer, thereby entitling him to "in-line-of-duty" death benefits, as allowed for in subsection 121.091(7)(c)(1), Florida statutes.
Findings Of Fact After having considered the recommended Findings of Fact Nos. 1 through 13 on pages 4 through 9 of the Recommended Order attached hereto as EXHIBIT "A", together with all matters of record reduced to writing, or in tangible form, as of March 9, 1990, the Division of Retirement hereby accepts, adopts, and incorporates by reference herein the recommended Findings of Fact Nos. 1 through 13 on pages 4 through 9 of the Recommended Order as a part of this Final Order, and, therefore, it is, ORDERED AND DIRECTED that the recommended Findings of Fact Nos. 1 through 13 on pages 4 through 9 of the said Hearing Officer's Recommended Order be and the same are hereby adopted in toto as part of this Final Order of the agency in this cause. Findings Of Fact John L. Durden, Petitioner, was initially employed by the State Road Department (SRD), the predecessor agency to Respondent, on September 29, 1952. He left the SRD on June 30, 1955, and was employed by the Florida Turnpike Authority (FTA) on July 1, 1955. Petitioner was employed by the FTA until October 9, 1958, and was reinstated at the SRD on October 10, 1958, and has been continually employed by this agency and Respondent. At the time Petitioner terminated his employment with the SRD, the Merit System in Florida had not commenced although the law became effective on June 20, 1955, when signed by the Governor. The Merit System became applicable to a state agency when that agency was so designated by the Governor. During the period Durden was employed by the FTA that agency was not placed under the Florida Merit System, but the SRD was placed under the Merit System. Accordingly, when Durden returned to the SRD in 1958, he became covered under the Florida Merit System. Leave policies in effect during the period between 1952 and 1958 provided that an employee earned annual leave at the rate of one working day per month during the first ten years of creditable service and one and one-quarter working days per month from the commencement of the eleventh year of creditable service. After state agencies came under the Merit System, State Personnel Rules promulgated thereafter were applicable only to agencies under the Merit System. When Petitioner returned to the SRD in 1958, there was no provision in the statutes or rules whereby Petitioner could use his prior service with the SRD or his service with the FTA to accrue ten years' creditable service for the purpose of computing earned leave. Accordingly, the entry on his personnel records that he would complete ten years' creditable service in 1968 was correct. In 1968 the personnel rules were changed to allow an employee, working for an agency under the Merit System, to earn ten hours of annual leave per month after five years of continuous and creditable service and twelve hours of annual leave after ten years of continuous and creditable service. These rules specifically provided they would have no retroactive application (Exhibit 11). In 1968 Petitioner completed ten years of continuous and creditable service with the SRD and earned leave in accordance with these rules. At the time Petitioner tendered his resignation to the SRD to accept employment with the FTA sick leave could not be transferred to a different agency. When Petitioner left FTA to return to SRD, any sick leave Petitioner had accrued at the FTA could not be transferred to the SRD because the FTA was not under the Merit System. The FTA was made a state agency by the Legislature when the FTA was created in 1953 Section 340.05, Florida Statutes (1955), but, as noted above, its employees were never covered by the Merit System. The pay records maintained by the Comptroller show that Petitioner was paid by state warrant issued from the Comptroller's office from 1952 until 1955 and from 1958 to the present. This indicates that FTA employees were not paid from appropriated funds but from revenues (or bonds) from the Turnpike.
Findings Of Fact The Division of Retirement will make no Findings of Fact relating to whether Petitioner's disability was in-line-of-duty. Accordingly, for the reasons mentioned previously, all findings contained in paragraphs 5, 6, 7, and 8, of the recommended order are rejected. However, the Division accepts the remaining Findings of Fact contained in the recommended order. As taken from the order these findings are: Herman Williams was an employee of the Department of Transportation and a member of the Florida Retirement System. The Division of Retirement approved payment of regular disability benefits to Herman Williams. Herman Williams is currently receiving and accepting these benefits. Herman Williams is an illiterate Seminole Indian, 62 years of age. Williams' duties with the Department of Transportation were driving a mowing tractor and cleaning out roadside ditches. Williams worked for the Department of Transportation approximately 21 years 11 months prior to being placed on the retired roles [sic]. On May 1, 1975, Williams was driving his tractor in the course of his regular employment at the Department of Transportation when the power steering of the tractor malfunctioned causing the front wheels to swerve violently, wrenching the steering wheel in Williams' hands and nearly throwing him from the tractor. Repairs had to be made to Williams' tractor by a Department of Transportation mechanic because the tractor was inoperative. The mechanic discovered a loose nut in the power steering assembly when he exchanged the power steering unit in Williams' tractor with another from the maintenance yard. When the new unit was installed in Williams's tractor it functioned normally. When the power steering from Williams' tractor was installed in the other tractor, it also functioned normally. The mechanic stated that the loose nut which he had discovered could cause the tractor to swerve violently in the manner Williams' had described. On the afternoon of May 1, 1975, Williams reported this instant [sic] to his supervisor, David McQuaig. Mr. McQuaig inquired as to any injuries to Williams and the tractor. Williams reported to McQuaig that the tractor had not been harmed and that he was only sore and stiff. No report of injury was prepared by McQuaig whose duty it was to file such reports. Williams' condition did not materially improve after seeking medical treatment by Dr. Albritton. Williams remained on sick leave until August 11, 1975, when it was exhausted. Williams then took annual leave from August 12, 1975 until September 23, 19975, when his retirement became effective. When the Petitioner's sick leave was exhausted, he was contacted by his supervisor in the Department of Transportation. He suggested that Williams could retire on disability if two physicians would state that he was disabled. This letter was read to Williams by his son, Eddie, because Williams is illiterate. Retirement application forms were provided Williams by the Department of Transportation. The physician report forms were completed by Dr. Albritton and Dr. Wilkerson. The statement of disability by employer form was completed by Williams' supervisor, David A. Young, Maintenance Engineer, for the Department of Transportation. Young stated that he completed the Statement of Disability by Employer, indicating that the application was for regular disability benefits because he had determined that no workman's compensation claim had been made by Williams and because Dr. Wilkerson's medical report had stated that the injuries occurred at Williams's home. The determination that the application was for regular disability benefits was solely Young's. The Application for Disability Retirement signed by Williams was prepared by personnel at the Department of Transportation District Office. This form was signed by Herman Williams; however, this form does not make provision for the member to state the nature of the disability benefits sought. Eddie Williams, son of Herman Williams, took his father to sign the forms at the Department of Transportation office. These forms were not explained to Williams, nor did Eddie Williams read them. Herman Williams was also unaware that such a benefit existed. Herman Williams stated he sought disability benefits based upon his injury on the job. Disability retirement was not discussed between Herman Williams and David Young. Based upon the application submitted in his behalf, the Division of Retirement made a determination that Williams was entitled to regular disability benefits. Williams was unaware that he was not receiving the in-line-of-duty benefits until his son inquired as to how much money he was receiving. When he was advised, he told his father that it appeared to be too little money. At this point Eddie Williams discovered that the application had been for regular disability.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, the Hearing Officer RECOMMENDS: That the administrator permit the applicant to file an amended application for disability in-line-of-duty retirement, and, further, that said application be approved. Dean, Hearing Officer, in Ocala, Florida, on September 15, 1977. The Petitioner requested relief from the Division's determination that Petitioner was not entitled to resubmit an application for disability retirement requesting in-line-of-duty disability retirement benefits because he had previously applied for and accepted regular disability retirement. The purpose of the hearing was to determine the factual basis for Petitioner's claim that he should be allowed to apply for in-line-of-duty disability retirement benefits. In addition to this determination, the Hearing Officer found that Petitioner was in fact entitled to in-line-of-duty disability retirement benefits. In making this latter conclusion, both as a matter of fact and of law, the Hearing Officer went beyond his scope of authority. As will be developed more fully herein, the Hearing Officer was without jurisdiction to consider the issue of whether Petitioner was in fact entitled to the in-line-of-duty benefits. Therefore, so much of the recommended order as purports to address this issue is of no effect, being the result of a hearing that did not comply with the essential requirements of law.
The Issue The issue is whether payment of Petitioner's retirement benefits should have commenced after the filing of an application to retire with the Division of Retirement, with an effective date of April 1, 2004, or be retroactively changed to the date of his termination of employment, July 1, 2003.
Findings Of Fact On July 19, 1995, Petitioner applied for membership in the Special Risk Division of the Elected Officers' Class of the Florida Retirement System ("FRS"). On August 14, 1995, Respondent sent Petitioner a letter admitting him into FRS. On September 6, 1995, Sarabeth Snuggs, Chief of the Bureau of Enrollment and Contributions for Respondent, sent Petitioner a letter revoking his membership in FRS. On December 17, 1996, Petitioner wrote to Sarabeth Snuggs responding to Respondent's decision to revoke his membership in FRS. Petitioner cited Section 121.052(2)(d), Florida Statutes, which provides that membership in FRS includes "any constitutional county elected officer assuming office after July 1, 1981, including any sheriff." The Consolidated City of Jacksonville was created by the Florida Legislature with the enactment of Chapter 67-1320, Laws of Florida. Section 1.01 of the Jacksonville Charter provides that the county government of Duval County and the municipal government of the City of Jacksonville are consolidated into a single body politic. The Charter further provides that the consolidated government succeeds to and possesses all of the properties of the former government. After being denied membership in FRS, Petitioner and other members of the consolidated government and its instrumentalities worked diligently to convince Respondent to admit Petitioner into FRS. During Petitioner's attempts to be included in FRS, Respondent repeatedly took the position that Duval County did not exist as a county agency. In a letter to Petitioner dated January 15, 1997, Ms. Snuggs wrote that the consolidated Duval County government "chose to consolidate as a 'city' government." Mr. Keane worked with the Duval County Legislative Delegation to amend Chapter 121 to specifically clarify the fact that the Duval County Sheriff and Clerk of Court are constitutional officers entitled to participate in FRS. In 2002, the Florida Legislature adopted language to clarify the Duval County Sheriff and Clerk of Court's status with respect to FRS. In a letter dated June 24, 2002, Petitioner thanked Ms. Snuggs for recognizing his right to elect membership in FRS. Petitioner observed that, since he was in the last year of his second term as Sheriff (Duval County allows only two consecutive terms), he wanted confirmation of his "right to connect the previous seven (7) years of service as Sheriff." The June 24, 2002, letter also asked for "guidance" from Respondent. The purpose of the June 24, 2002, letter was for Petitioner to learn how Respondent intended to treat his first six years of service. Petitioner sought to avoid any problems since his retirement date was rapidly approaching. On October 10, 2002, Petitioner and Mr. George Dandelake, the Chief of the Budget and Management Division of the Sheriff's Office, wrote to Ms. Snuggs requesting a calculation of the amount of employer contributions required on Petitioner's behalf. The October 10 letter also requested that Respondent "identify what documents are required, in addition to the contribution amount which will be paid by the City, that must be supplied to the Florida Retirement System." Petitioner re-applied for membership in FRS, which was granted on June 1, 2002, after the effective date of the legislation designed to specifically admit the Duval County Sheriff and Clerk of Court into FRS. On June 18, 2003, twelve days before the expiration of his term of office, still not having received confirmation of the status of his prior service, Petitioner sent a letter to Ms. Snuggs advising that FRS had not recognized his service from 1995 through 2002. Petitioner again stated in the letter that he was terminating his position as Sheriff on June 30, 2003. Less than a week prior to the termination of his term, Petitioner received two "Statement[s] of Account" dated June 24, 2003, indicating that "you have until retirement to pay the amount due on your account." The statements further indicated that "when you become vested for monthly benefits, we will provide you an estimate of benefits with and without this service." According to the first Statement of Account, Petitioner was entitled to purchase prior service at the 1.6 percent multiplier rate for the FRS regular class. According to the second Statement of Account, Petitioner was entitled to purchase prior service at the 2.0 percent multiplier rate for the FRS special risk class. Neither Statement of Account was correct, as both failed to permit Petitioner to purchase service at the 3.0 percent rate for special risk, despite the fact that Petitioner had served a continuous and uninterrupted term as Sheriff. The Statement of Account did not advise Petitioner that he must submit a separate retirement application, Form FR-11, in order to preserve his retirement date. The statement did advise Petitioner that interest would be assessed at a rate of 6.5 percent. This warning appeared in bold face on the Statement of Account. The June 24, 2003, statements were the first time that Petitioner was supplied with the amount due to purchase service credit. Since neither statement applied the correct multiplier rate (3.0 percent) for all eight years of Petitioner's service as Sheriff, neither statement was correct. Recognizing that only six days remained prior to the expiration of Petitioner's term as Sheriff, Mr. Keane advised Petitioner to submit payment to Respondent on an expedited basis. After receiving the June 24, 2003, Statements of Account, Petitioner prepared a letter dated June 26, 2003, to Cal Ray, the Director of the Department of Administration and Finance for the Consolidated City of Jacksonville. In this letter, Petitioner requested an employer contribution in the amount of $163,554.32 to purchase his prior service. Petitioner further requested an expedited preparation of the check to ensure delivery to Respondent by July 1, 2003. The letter to Mr. Ray requested payment of the amounts that would have been periodically contributed by the City of Jacksonville if Respondent had been acknowledged as a participant in FRS in 1995. On June 27, 2003, three days prior to the expiration of his term of office, Petitioner drove from Jacksonville to Tallahassee to meet with Respondent's representatives, including Ms. Snuggs, regarding Petitioner's retirement. Mr. Dandelake accompanied Petitioner on this trip. At the June 27, 2003, meeting, Petitioner personally delivered a check to Respondent in the amount of $163,554.32. Respondent accepted the check and issued a written receipt signed by Sarabeth Snuggs. Petitioner was never told during the June 27, 2003, meeting with Respondent that he would forfeit benefits if he failed to complete an application. Respondent knew that Petitioner was leaving office on June 30, 2003. Respondent never discussed the filing of an application for retirement benefits at any time during the course of its conversations and correspondence with Petitioner. Petitioner was never told by Respondent to complete any forms to protect his rights to the 2.0 percent multiplier during the pendency of his dispute with Respondent. Petitioner was never provided any handbook, notice, statutes, or rules indicating he would forfeit benefits under any circumstances. When Petitioner left the June 27, 2003, meeting, both he and Mr. Dandelake understood that he was still engaged in a dispute with Respondent over his entitlement to the 3.0 percent multiplier. Petitioner knew that he was required to file an application in order to receive retirement benefits. Petitioner testified that if he had left the June 27 meeting with any indication that he would forfeit benefits by not filing an application, he would have filed something, with advice of counsel, to preserve his rights. Petitioner received an Estimate of Benefits via fax from Respondent on June 27, 2003, reflecting an annual benefit of $23,105.90. This statement valued 6.92 years of Petitioner's uninterrupted special risk service as Sheriff using the 2.0 percent multiplier, and 1.08 years of service as Sheriff using the 3.0 percent multiplier. The June 27, 2003, statement lists Petitioner's retirement date as July 1, 2003. The estimate does not warn Petitioner that he must do anything in order to preserve his July 2003 retirement date. The estimate states only that it is subject to "final verification of all factors." Petitioner's term of office as elected Sheriff ended on June 30, 2003. Petitioner's employment terminated when his term expired on that date. Respondent was aware of the dates of the expiration of Petitioner's term of office as well as his employment termination date. When Petitioner's employment terminated on June 30, 2003, it was unclear whether he would be credited with the 3.0 percent multiplier for his eight years of special risk service. Petitioner was not notified by Respondent prior to the expiration of his term as Sheriff on June 30, 2003, that he needed to submit a retirement application. The first time Petitioner was advised by Respondent of the need to file an application for retirement benefits was in the comment section of the Estimate of Retirement Benefits provided to him by letter dated March 4, 2004. The warning was printed in bold face type. The Estimate of Retirement Benefits dated June 27, 2003, did not include the bold face warning to file an application. Respondent was not provided with a Division of Retirement publication entitled "Preparing to Retire" prior to his leaving service on June 30, 2003. In fact, the copy of the publication offered into evidence by Respondent is dated "July 2003," subsequent to Petitioner's retirement. As the only member of FRS in his office in Jacksonville, Petitioner had no staff or employees trained in FRS or Florida retirement benefits. Petitioner was provided with a "Preparing to Retire" booklet in March 2004. On November 3, 2003, Florida Attorney General Opinion 2003-46 confirmed that Petitioner, as the elected Sheriff, was eligible for membership in the Elected Officer's Class of the Florida Retirement System. On December 31, 2003, and on January 16, 2004, Petitioner's counsel attempted to obtain clarification from Respondent regarding Petitioner's retirement benefits. The December 31, 2003, letter noted that the "extraordinary delay" in resolving the issue of Petitioner's benefits was at no time due to fault on the part of Petitioner. Respondent never refuted or disputed this statement. By letter dated March 4, 2004, Petitioner was finally advised by Respondent that he was entitled to be credited with the higher 3.0 percent multiplier for all eight years of his service as Sheriff. Petitioner noted that the March 4, 2004, Statement of Account, while properly applying the 3.0 percent multiplier, now had changed Petitioner's retirement date to April 2004 from the previous estimates showing a retirement date of July 2003. The March 4, 2004, statement included the bold face notice to Petitioner that he must file an application for retirement benefits. No prior notices or correspondence from Respondent had informed Petitioner that he must file Form FR-11 in order to retain his retirement date of July 1, 2003. After formally being notified that he would receive the 3.0 percent multiplier for all eight of his years of service as Sheriff, and after having received the notice that he must file Form FR-11, Petitioner submitted the form in April 2004. Respondent is a fiduciary charged with acting in the best interest of participants in FRS. Andy Snuggs, who travels around the state educating employers and employees in FRS, acknowledged that Petitioner was not responsible for the delay by Respondent in recognizing Petitioner's entitlement to the 3.0 percent multiplier. Mr. Snuggs acknowledged that he does not tell employees that they will forfeit benefits if they delay the filing of their applications. Petitioner received his first retirement check in May 2004 which was based upon the benefit established in March 2004 of $32,624.58 annually, not the $23,105.90 previously established by Respondent in June 2003. Petitioner has received no retroactive benefits for the period of July 1, 2003, through April 30, 2004. In a letter dated May 6, 2004, Petitioner stated that his acceptance of the first retirement check was not to be construed by Respondent of a waiver of his rights to retroactive benefits from July 1, 2003, forward.
Recommendation Based upon the Findings of Fact and Conclusions of Law, it is RECOMMENDED that Petitioner be awarded retirement benefits at the rate of 3.0 percent per year for his eight years of Elected Officer's Class of service, retroactive to July 1, 2003. The Issue The issue presented is whether Petitioner's application for retroactive retirement benefits should be granted.
Findings Of Fact Petitioner was employed by the Palm Beach County Sheriff's Office for approximately twelve years, working in a special risk capacity. As a result of that employment, he was a member of the Florida Retirement System. In 1972 Petitioner completed Respondent's form FRS-M10 setting forth his membership as a special risk member of the Florida Retirement System as of November 1, 1970. Petitioner resigned his position on March 15, 1982, when he was 47 years of age and had more than ten years of creditable service. At the time of his resignation, he was employed in the position of Inspector, Director of Law Enforcement, the third in command at the Sheriff's Office. There are approximately 550,000 active members in the Florida Retirement System. Many members choose not to submit an application for retirement benefits on their normal retirement date for a variety of reasons. An application for retirement benefits is a prerequisite for the establishment of an effective retirement date for a member of the Florida Retirement System. In September of 1991, Petitioner applied for retirement benefits. At the time of his application, he was 57 years of age. Petitioner never contacted Respondent to request information or advice regarding his retirement benefits prior to filing his retirement application in September of 1991. Based upon receipt of Petitioner's application for retirement benefits in September of 1991, Respondent established October 1, 1991, as Petitioner's effective retirement date. In October of 1986 Petitioner received from the Palm Beach County Sheriff's Office a copy of some of Respondent's forms which are utilized by persons filing applications for retirement benefits. Some of the information included in that package relates to persons who are regular members of the Florida Retirement System, not special risk members.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that a Final Order be entered denying Petitioner's request to change his effective retirement date and denying Petitioner's request for retroactive retirement benefits. The Issue Whether Petitioner is entitled to "in line of duty" death benefits from the Florida Retirement System (FRS).
Findings Of Fact In assessing whether or not a death was "in line of duty," the Division of Retirement, in 1979, regularly relied upon the certificate of death; the Workers' Compensation First Report of Injury; the autopsy report, if there was one; any investigative reports or statements made by witnesses; and the final determination of the Workers' Compensation agency. Other items were also required, but if the Division of Retirement would have relied on this type of information then, which it would have, and if FRS requested and considered this type of information in denying Petitioner’s claim in 2003, which it did, it is appropriate that all of these sources also be considered in this proceeding, even without predicate, as to their internal hearsay statements. Where available, those items have been considered in this proceeding. This methodology is also approved and codified in Section 121.021(14), Florida Statutes. See the Conclusions of Law. That said, no single document is determinative of the issue of entitlement. On June 9, 1979, Donald Shackelford was a Volusia County Sheriff's Deputy and a member of FRS, with approximately one year of creditable service. On June 9, 1979, Deputy Shackelford was 36 years old. He passed away in his sleep at approximately 3:30 a.m., several hours after leaving work. The Workers' Compensation First Report of Injury on Deputy Shackelford was prepared by the decedent's supervising sergeant. It relates that Deputy Shackelford had stated at 1:19 a.m., on June 9, 1979, that he was not feeling well; was having cold chills; and was experiencing passing numbness in his hands. The Report states that those "injuries" were reported by Deputy Shackelford at 1:12 a.m., and that at 12:05 a.m., the deceased had been on duty and involved in a fight while arresting a suspect. There is no dispute that Deputy Shackelford was relieved of duty and went home before the end of his regularly scheduled shift on June 9, 1979. At the time of his death, Petitioner was married to Deputy Shackelford. Petitioner testified that when Deputy Shackelford arrived home early on June 9, 1979, he told her he had received a blow to the chest during a fight/arrest while on duty earlier in the evening. She believed that this blow caused his death. Deputy Shackelford had driven himself home in a patrol car, which he was required to keep at his residence even when he was off-duty. He also was required to be “on-call” 24 hours a day. However, he was not "on duty" at the time of his death. Later on June 9, 1979, an autopsy was performed by Dr. Schildeker, M.D., with the final diagnosis being: [T]hrombosis, right coronary artery, recent; myocardial infarct [infarction], early posterior left ventricle and septum; artherosclerosis, calcification coronary artery, severe; dilation right heart, moderate; pulmonary edema, acute. (R-15). The autopsy report also notes that there were bite marks (presumably from the resisting arrestee the night before) on Deputy Shackelford's arm, and lividity to the left side and lower portion of his face, neck, and upper shoulders. It does not note any bruising to his chest. (R-15). The autopsy report also reveals that ". . . in the coronary artery, approximately 4 centimeters from the point of origin there is an acute antemortem [before death] thrombosis which is completely occluding the lumen of the vessel." A current medical dictionary defines "thrombosis" as the formation of a blood clot in a vein or artery. Without expert medical testimony, the undersigned cannot determine if the "lividity" described in the autopsy report is bruising that occurred while Deputy Shackelford was alive or if it was postmortem lividity, which is the after-death settling of blood caused by the position of a body. However, the autopsy report also states: Careful examination of the body reveals no wounds or injuries that are contributory to the death. (R-15). The certificate of death form was also signed by Dr. Schildeker, M.D., on June 18, 1979. The form allows its signator to choose between "(Probably) accident, suicide or homicide, or undetermined." Deputy Shackelford’s certificate of death specifies "natural," on this blank. It also states under "Describe How Injury Occurred," the words, "Had coronary while making arrest." The "causes of death” listed on the certificate were, in order of descending immediacy: immediate cause: myocardial infarct [infarction], posterior; due to or as a consequence of: thrombosis, right coronary artery; and due to or as a consequence of: ASHD [artherosclerotic heart disease (R-7)]. Petitioner was represented by a lawyer for her workers' compensation claim. On June 29, 1979, she began to receive workers' compensation death benefits from Volusia County. The County was self-insured for workers' compensation purposes under Chapter 440, Florida Statutes. (P-3 and P-4). On July 27, 1979, the National Sheriffs' Association denied that Deputy Shackelford’s death was covered by its accidental death and dismemberment policy, because the death had been ruled "natural." (R-23). Within a month of Deputy Shackelford's death, Petitioner and their children relocated to Virginia Beach, Virginia. At the time of this relocation, Petitioner definitely provided forwarding information to her lawyer and possibly to Volusia County. On September 10, 1979, after being notified of Deputy Shackelford's death, the Division of Retirement sent a letter to the Volusia County Personnel Office, outlining the requirements for survivors, in this case Petitioner, to claim FRS benefits as a result of Deputy Shackelford’s death. (R-3). In 1979, the Volusia County Personnel Office's procedure would have been to forward the Division of Retirement information concerning the FRS claim requirements and the application to the surviving spouse at the spouse’s last known address. However, it cannot be verified whether or not the Division of Retirement's information was forwarded to Petitioner. Petitioner testified credibly that she never received the Division of Retirement's information from Volusia County. Petitioner subsequently remarried in 1980. On October 26, 2000, the United States Justice Department denied Petitioner benefits pursuant to the Public Safety Officers' Benefits Act, 42 U.S.C. § 3796 (PSOB), because the decedent's certificate of death suggested death was from a heart attack, and the cause of death was listed as "natural." The definition of "personal injury sustained in the line of duty" under that Act requires that the claimant demonstrate "that a traumatic injury was a substantial factor in the public safety officer's death." (P-7).
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Department of Management Services, Division of Retirement, enter a final order denying Petitioner's request for “in line of duty” death benefits. Findings Of Fact The Petitioner is the surviving spouse of Huldah C. Roach. At the time of her death, Mrs. Roach was a retired member of the Florida Retirement System, and was receiving retirement benefits pursuant to Chapter 121, Florida Statutes. The Respondent, Division of Retirement, sent Mrs. Roach her retirement benefits for the month of June, 1977, at the end of that month. The warrant for the retirement benefit was received by the Petitioner on or about June 30, 1977, and was deposited by him in the joint account which he had shared with Mrs. Roach. On June 8, 1977, Mrs. Roach died. By letter dated July 4, 1977, the Petitioner advised the Respondent of his wife's death. He also advised the Respondent that he was holding the benefit warrant, but in a telephone conversation on August 22, 1977, he advised the Respondent that the warrant had been deposited in the joint account. By letter dated August 24, 1977, the Respondent advised the Petitioner that Mrs. Roach was entitled to retirement benefits only up to the date of her death, and that $330.81 of the June payment thus represented an overpayment. The letter included a demand for repayment of the asserted overpayment. The Respondent made no effort to collect the asserted overpayment between August 24, 1977, and December 5, 1979, when the Respondent, through counsel, forwarded a demand letter to the Petitioner. The petitioner was not able to identify what expenses he paid from the June, 1977, retirement benefit. Mrs. Roach received retirement benefits in excess of her total contributions to the Florida Retirement System, and under the retirement option that she selected, she was entitled to no additional benefits after the day of her death. The Respondent has consistently interpreted provisions of the Florida Retirement Law as allowing payment of retirement benefits only through the date of a retiree's death.
