Auto accident
My boyfriend was driving my car with me as passanger. We were parked, a woman was looking for a parking spot and passed us, so we pulled out of the spot only to see she was reversing back towards us. We were stopped because we saw her coming & had been honking the horn for 7-10 seconds before she hit us. She asked us not to call the police & to get an estimate & she would pay for it out of pocket (we exchanged insurance, my insurance because it was my car). When I got the estimate she said she would only pay for the tail light & that's all the damage she caused. She tried to threaten me that she is a paralegal, & tried to blackmail me that if I reported it my boyfriend would get charged for driving without insurance (even though my car was covered & he has insurance for his car). I filed a claim with her insurance & after a month & a half they finally assessed the damage was more than the tail light. But now the insurance company is saying that it is 50/50 fault, even though she told her insurance & my insurance that she was at fault, & I have her on a recorded phone conversation saying she is at fault. Her insurance company refuses to return my calls. Do I have a chance if I sue the insurance company?
