I was wondering how do I go about filing for custody if there is an order already in place. I am going back becaus my daughter is living with her father but the problem is that she never stays at his house. He always takes her to his mothers house and she stays there and she gets her up and takes her to the babysitters then. if she were living with me she would eb staying in her own bed and I would be the one to get her up and ready for school in the morning. would the court take this into consideration?
