Petitioner Gulf Power Company showed that the numerous statutory and regulatory requirements have been met, justifying certification of the subject electrical generating facility.
The issue for determination is whether the original and amended petitions for hearing were filed late and should be dismissed pursuant to Section 120.569(2)(c), Florida Statutes (1997), and Florida Administrative Code Rule 62-110.106(3)(b). All references to rules are to those promulgated in the Florida Administrative Code in effect on the date of this Recommended Order.)The affected party who filed a petition for hearing 18 days late waives the right to a hearing.
