The issues in this case are whether the Gainesville Renewable Energy Center, LLC (GREC) is entitled to an Air Construction Permit from the Department of Environmental Protection (DEP) for the construction of a net 100-megawatt (MW) biomass-fired electrical power plant in Gainesville, Florida, pursuant generally to state rules that relate to the federal Clean Air Act, 42 U.S.C. §§ 7401, et seq. (Clean Air Act), which is administered by the U.S. Environmental Protection Agency (EPA). Specifically, the issues are whether the proposed project satisfies the requirements of Florida's EPA-authorized air program of Prevention of Significant Deterioration (PSD), as set forth in Florida Administrative Code Rule 62-212.400, and Florida's EPA-delegated air program of National Emission Standards for Hazardous Air Pollutants (NESHAP), as set forth in Florida Administrative Code Rule 62-204.800(10) and (11).GREC provided assurance that draft Air Construction Permit complies with relevant provisions of AAQS, PSD, and NESHAP; DEP will prohibit demo/debris biomass; incorporate of fire-safety changes; ID trona as sorbant for DSI; and add EPA Method 202.
