Cosigner

my husband co-signed student loans for his adult daughter. she has not made a payment, and now we are getting the monthly bill and paying. Do we have any legal recourse?

Hello!

You are in the proverbial damned if you do and damned if you don't.

Fist, as cosigner(s) you are legally primary obligors (1st responsible) for the signed for debt. Since Mom & Dad are married, in California, this is a community debt.

Second, your remedy is to seek recompense from your errant child--good luck there!.

I wish I had better news for you, but I don't.
