credit card collections

A family member of mine recently was incarcertaed and will be for a while. We are now receiving collectors notices from attny offices. If his name was the only one on the account, can the collectors go to his spouse or other family to pay this money?

Re: credit card collections

For most debts, a collector may not contact a debtors' family members or others about the debt they are collecting. There are some, debts that a spouse can be liable for, even if they did not sign anything. Those have to do with life saving medical treatment and food or shelter, and are very rare. Tell the collectors that teh person is incarcerated, and in what state. They should leave you alone then. If not, you may have a cause of action against them.

Good Luck
