Domestic Assault/Terrorist Threats
My boyfriend/ex-boyfriend is involved in a domestic assault and terroristic threats both felony charges against me. He has chosen to bring it to trial, I don't want to testify against him cause I can't and I love him, would it be better if I left so they can't subpoena me or is it better for his case if I was to testify. You can be subpoenaed to testify and that is likely to occur. If you refuse to testify, you can be held in contempt. If you refuse to appear when subpoenaed, you can be arrested and brought to court.
Certainly, the defenses case becomes stronger when there is a reluctant witness. It does not destroy the prosecution's case, but it significantly weakens it.
