Elder Law

Since 1995, I have shared bank accounts with my mother allowing either/or access. She is now (3 years) in an assisted living facility and the cost exceeds her income (SSI & pension).

Will Medicaid try and seize these joint funds if she must go to a nursing home, or can this be considered ''my'' account?

Your question cannot be answered in a simple fashion. What is required is an examination of the facts and circumstances, so that you can plan for the care of your mother for the remainder of her life. For example, I do not know how the ownership of the bank account is held.
