Executor is stonewalling

My Aunt died leaving a trust for her

sister-in-law (my mother) and her

own sister. They are in their eighties.

The executor of the estate was my

aunts stock broker and she has been

stalling on finding a co-trustee for the

estate. It has been 10 months now

and none of the estate has been

dispersed to these elderly women.

She does not return phone calls from

their POA's, isome tems from the

home were taken by my Aunts

friends and the personal

representative and our family who

legally inherited the contents of the

house were refused a key to access

the items until the representative

allowed us entry for one day. What

recourse does our family have to get

an accounting of the estate and can

the beneficiaries of the estate find

another co-trustee, as the executor

only wants to use a specific bank in

her town that is too small to be co-

trustee. We are afraid the estate is

dwindling as she drags this out and

stonewalls us at every turn. Do we

have grounds to petition for another

executor?

Based upon what you have said here, it appears that you have grounds to petition the Court for a change of Executor. It will need to be brought on behalf of the beneficiaries. There may be grounds to to take action against the Executor as well. Seek good probate counsel to assist you.
