getting refund from contractor

we gave a 5K deposit to a contractor to rebuild our deck. When he filed for the permit, the overall price was higher than the quote, and he wasn't including trash removal or porta-Johns. We decided not to do it. Contractor said he would refund the deposit but has been blowing us off. The contract doesn't have any cancellation clause. What would be the next step?

Have you lawyer look the contract over. If you had a firm price in the contract, the contractor has to do the work even if he bid too low or left things out that he needed.
