insurance coverage not willing to pay
If I was involved in a roll over accident caused by a drunk driver, wouldn't the owner of the vehicle's insurance fully cover the driver? Does the other driver need to be named in the policy for it to become a drop down policy? My medical bills are almost $70,000 and counting, but my attorney is telling me that there is not enough money to cover me. What about my loss of current and future wages?
Re: insurance coverage not willing to pay
The policy limits of the driver's or owners' insurance [if any] are the max you are going to recover, regardless of your losses, unless the driver has assets and income that you could collect from in excess of the policy. Ask your attorney, he knows the facts. Make a claim on your own Uninsured Motorist policy. Word to the wise: increase your Uninsured Motorist policy coverage to the max level of your liability, which should be a minimum of 100/300. 1/4 of the drivers on the road in CA are uninsured.
