My Mother's Will

My mother passed away a little over a month ago. My brother and I are her only children. He will not let me see the will. The last time I saw it I read that he would receive the house and I would receive the land that she owned. He is no saying the the land was sold a couple of years ago and the will is no good. Could you please tell me what I can do in this situation. Thank you very much!!

Re: My Mother's Will

You can file an application for formal probate, which requires a hearing before a judge. You and your brother can then each tell the judge what has happened. If there is an existing will, your brother will have to produce it. If there is no will, then you and your brothers and sisters will receive an equal share of your mother's assets after her debts and the costs of administration have been paid. You should have an attorney assist you with this.
