Trademark infringement and licensing

Hi,

I have two questions:

1. I own a trademark for a certain toy which is widely infringed these days.

I'm looking for a law firm that can prosecute the companies that infringe my trademark but I would like to pay on a commission basis.

Means that only a certain percentage of the collected money from the companies that infringe my trademark. Please let me know if you know of a law company like this that can pursue without an upfront fee.

2. I have another toy that I designed and I would like to present it to a large company in order to negotiate with them the terms of a possible agreement for co-operation.

I would like to know costs of such service with advantage to law companies that have experience in the toy industry.

Thanks,

Idan

Re: Trademark infringement and licensing

I know of no attorneys that would agree to police your trademark on a commission/contingency basis and particularly because there are costs involved. What you can do is shop around for a good hourly rate and an attorney that does not have a "sharp pencil" in billing practices. As to the second part of your post, I am not sure what the question really is and whether you're asking for business advice or a comment on the legal costs associated with assisting to draft a non-disclosure agreement and, potentially, a distribution, partnership, joint venture or other form of collaboration.
