divorce and realestate
I am legally divorced. My x-husband is refinancing our house and my name will be removed after he buys me out. He will still live in the house. He wants to include realitor charges so if he sells the house in the future I will of payed my portion of the realitor fee. I want to know if that is fair and right. We have no attorneys involved at this point.
Step father passed 4-5-07 want to challenge will
My daddy(step-father) had raised me since I was 6 mo old, my mother and he divorced after 18yrs, but he was still my daddy for a total of 35 yrs. A few yrs after divorce, he meet a married woman had affair, changed his will saying that he didn't want my mom to get anything, but that his friend had special instructions to follow. Since his death, they wont speak to me or my aunt. Wont let aunt have house that had been in family for yrs, they offer to buy it, still no. They left us to pay for funeral, headstone and so forth. Wouldn't let me purchase his truck, I believe they used him, my mother cheated for 17yrs, dad lonely. My daddy and her hadnt spoken in 3 yrs. She wouldn't even see him on his death bed. With being step-child do I have any rights? They also made sure that all family members din't speak to one another at funeral by telling lies, assuming we might put 2 and 2 together which we have now. Plz help.
brother died without a will
My brother died without a will and he has a daughter, son and step brother. My mom and dad are still alive and I am his only sister. At this time my grandmother has temporary custody of my nephew. We will be going to court on Monday, April 13th in County Court because she wants to have control of my brothers estate.
I was told that in the state of Texas when someone dies without a will any assets are divided 50% to parents any sisters living, then the other 50% is goes to the surviving children. Is this correct? If so how can we get this processed through the court? Since I am not a party to the suit and the hearing is this Monday can I request the court to reset the case so that I can hire an attorney since I am the sister. Ultimately, I have been the main caregiver for my brother and his son until he died and I would like custody of my nephew since he is use to living with me. This would be in the best interest of my nephew especially since he is under the care of the elderly Great Aunts who really don't have the patience nor the best of health to care for him. Please advise?
