My wife traveled to the U.S five months a go with her issued immigration visa. She got back to her country (Iran) to sell her home, car... etc. During five months her green card was mailed to the home in Tustin, CA. However, her flight was canceled by the air-line. So, she might be out of the U.S more than 6 months. Is there any problem for her permanent residency? If there is any problem, what must she do to solve her problem?
A 6 month absence from the US merely puts her ability to naturalize at risk ... make sure she's not out of the US for more than 12 months ... AND ... that she keeps records of her US contacts.
DHS has not published any guidance yet for such circumstances. However, typically if a resident can document his/her stay outside the U.S. was lengthy due to circumstances beyond his/her control, she would not be deemed to abandon his/her residence. She should returned to the U.S. as soon as she can safely do so.
We are not as yet seeing DHS/USCIS issue guidance regarding long absence from the US from COVID-19. Existing rules provide one doesn't abandon a green due to long absence from the US beyond one's control.
My husband recently left me for a woman who has no legal authorization to be in this country. He admits she is the reason he left our relationship.
About four weeks ago I posted comments on some of her facebook pictures saying things like "whore". I also emailed her boss saying that is was a shame that donors pay the salary of a woman who spends her afternoons in bars trying to fuck my husband.
Since that one evening, I have not done any of those things again. Two days ago she messaged me saying that I had to call her or she would have me arrested. I told her we had nothing to talk about. She said she would see me in court.
While I realize my actions make me look bad, are they valid grounds for harassment charges?
