Hello today myself and my wife went into Costco and as for several years I was carrying my emotional support dog. I am on full disability and have a registered support animal. I was approached by the manage and was told to leave the store. That they do not recognize esd animals. He embaraced me in front of other customers by asking me if I was truly disabled and if my dog just had a paper saying that he was a support dog. This was horrible and then he said I could go to customer service and get a refund for my membership. This was a humiliating situation.
There is a world of difference in training and behavior between a service animal and an emotional support animal. Service animals are highly trained; they perform specific functions for their disabled human and they are safe around strangers. The Americans with Disabilities Act (ADA) is enforced by Housing and Urban Development (HUD) in a way that protects the housing rights of the disabled who have service and legitimate emotional support animals (ESAs. When it comes to ESAs, it is not enough to have the ESA "registered," but the disabled human must present medical documentation of the specific mental disability and the need for the emotional comfort provided by the animal. Businesses have become painfully aware of the abuse of service animal rules by thoughtless customers who bring their pets shopping, and the online industry that provides phony "registration" for ESAs. Other shoppers feel threatened by such animals and many object to animals being present where food is sold. So, businesses have developed policies to protect their customers. Except for the laws regarding real trained service animals, no business is required to allow animals on premises. It is regrettable that you chose to take offense when informed of this policy.
No statute exists in Idaho. Support animals laws provide protection against landlords who would otherwise forbid animals.
An emotional support dog is not a service animal under the Americans with Disabilities Act and absent a statute in your state on point, any store can ask you to leave because of the animal.
