Our dept shut down because of the covid-19 outbreak. We were told in order to keep our jobs we will be shuffled to other hospital depts. I think this is increasing our exposure to the virus. Is this move legal?
“Employees at will,” which are what just about all employees are south of the Mason Dixon line, serve at the pleasure of the employer and can legally be fired for no reason or for an “unfair” reason. Unless you have a contract for a particular term of employment, or are protected by a collective bargaining agreement, you are most likely “at will” and out of luck.
I changed your practice area to employment law. Unfortunately yes. If you have a pre-existing medical condition, you can request for a waiver. Virginia is an at-will state, which allows terminations for nothing. If you have an enforceable contract, you may have a claim. Speak with an employment law attorney in your area.
