Did the police know for sure that the owner/driver was going to pick up the vehicle? Even if it is on the soft shoulder it can be a danger as drunk drivers often smash into stopped vehicles. if you file a claim [must do so within 180 days], they will just reject it and you probably will not win in Small Claims Court [if you do, they can appeal it and then you will face one of their attorneys in Superior Court].
