There is an innocent owner form that can be filled out and submitted and a Judge will decide. Like most Court related things the assistance of an attorney will likely be necessary.
There is a way for certain “innocent” owners to petition the Court for return of the vehicle. We often times see an attorney for the Lienholder come into court in Charlotte, with supporting documentation, and get the car or whatever released.
BUT if the inquiry involves the PERSON CHARGED getting the vehicle back, that’s problematic, at best.
It’s frankly pretty complicated. And given how vehicle seizure works, one works might assume there is a prior history of DUI-DWI issues.
Makes sense to retain an experienced DWI LAWYER to help answer these and the myriad of other questions.
