Domestic partners with shared lease domestic violence reported offender won't leave residence. How long does one party need to be out of residence to claim abandonment of lease? DV has been reported to police but he always comes back when police leave and makes threats.

Both parties must be out of the premises without apparent intent to return before you can even talk about the lease being deemed abandoned.

If you have ongoing domestic violence issues, you need to look into getting a DV restraining order, not trying to use real estate law.
