I totaled my car and we are currently in a chapter 13. The car was outside the bankruptcy do we need to tell the trust

Yes. You should notify the trustee before taking any action.

What do you mean "outside the bankruptcy"?

If you are paying for it outside the plan directly to the creditor, then your insurance should take care of any debt on it because if there is a shortfall or deficiency it can be added to your unsecured creditors in the plan. On the other hand, if you failed to disclose you have another problem.

In any event, I think you should talk to your lawyer about what happens next.
