If our state goes into lockdown over spring break this year because of Coronavirus, where do they go?

Since you have a SHARED PARENTING PLAN-- the Plan has a schedule that says who has custody and when. That means that the clock ticks from each set time to the next-- and when the clock changes from your custody to the other parent's time, they are the custodian.

Read your Plan-- it should set up a full schedule which you negotiated. That should include who has the kids if during the school year the school is closed-- if correctly drafted.

You have two choices here. A) Follow that Schedule, or B) Negotiate a short term schedule during the corona virus outbreak.

One of the most important facets a Shared Parenting Plan requires is communication, so, call the other parent and discuss the best options. Work it out-- Courts are also operating on a limited basis-- so guess what? You are the parties in the best position to negotiate an optimal outcome-- and if you can't, then follow the Order you agreed to in the past. Good Luck. CPB

I would suggest that there is not a legal answer to your question. A lockdown is unprecedented and not a matter that is covered by most - if any - agreements between separated parents. Exchange of children for purposes of a parenting schedule may or may not be an exception to a lockdown order. Currently, it appears that a lockdown is not expected to be necessary. However, it makes sense for the two parents to discuss the possibility and have an agreement in place if the time comes. There are millions of children and parents in this situation and few are likely having the conversation to plan ahead. Unless and until a lockdown occurs, parents should continue to abide by the terms of their parenting order unless they can deviate by agreement. As in all matters concerning children, the more the parents are able to talk and work things out by agreement the better everyone will be.
