if you sign a contract with a company and are paying monthly and they state on the contract the payment will come out on a certain day and it never comes out on that day, can you get out of the contract?
Depends on how crucial it is in the contract ....but because it does not come out on the specified day I would think that this is not material to the contract and would not rise to the level where the contract could be breached.
