Repurchase/replacement of lemon vehicle.
Would I be better off waiting to file for lemon replacement until AFTER the manufacturer declares BK and is out of it, or would a person be better off filing BEFORE the BK is announced, and try to race the manufacturer's potential BK?
I ask all of this because I have a car that qualifies as a lemon, and I believe the manufacturer might file BK this year.
It depends on the type of bankruptcy, 7 or 11, and if the lemon law claims are treated in any plan that is approved. If you have a claim, and the manufacturer is in the tank, then you should have your lemon law lawyer file a claim in the case
Generally no. But it can be case specific so you should check with the trustee.
