My fiance entered the country on December 26th. We got our marriage license from the county and got married on February 28th. The County Clerk is not accepting in-person requests due to the coronavirus shutdown, and so we have to request by mail, which will take at least 20 days, which puts us far past the March 25th deadline. We will not be able to file our adjustment of status application until after the 90 days are up. Can we do that? Do we have to start the process over with the I-130?
Is it okay to file the adjustment of status after 90 days? Is there any risk to late filing? What is my fiance's immigration status between the end of his visa validity and the change of status filing?
Yes, you could file for K-1 adjustment even after the 90-day admission expires, as long as the qualifying marriage was entered into within 90 days of K-1 arrival. No need for I-130.
A K-1 married before 90 days, can file adjustment of status after 90 days. The risk to filing late is being found not in status and picked up by ICE. Otherwise, you may file later.
Profiling
I work for an electric company that has employees searching for hispanic names with phone numbers in the south Florida region. Then they locate the address and ''look'' for signs of a grow house and then give information to the local police. Some of these people who were charged with a crime are in state and Federal court. Is this type of practise legal for our electric company employees legal or are they putting the company at risk?
verbal agreement to sublet
I verbally agreed to rent 100 sq ft of shared studio space on 11/1, and gave the woman a check for 1 mo rent and deposit. By 11/2 she changed many terms, restriciting my use, space, and access so that it didn't match my needs or her advertisement for the space. She didn't return my email or call suggesting a solution or asking for my rent back, so I put a stop payment on my check on 11/3. By 11/6, she wanted to keep 1/3 of the rent and the whole deposit and has threatened me legally. Am I responsible financially to her? (Also - her lease prevents her from subletting, and this was supposed to be an undercover agreement.)
