Second degree eluding charge is 5-10 yrs in State prison. Third DUI carries 6 months of County jail.
Depends on exactly the degree he is charged with, but for 3 DWI's assuming he had no priors and was convicted on each then he is looking at up to 300 days in jail and for the criminal charge anywhere up to 10 years, although generally I see this charged lower so the maximum may only be 5 years. The fact that he destroyed his car and private property obviously would make this a worse case scenario unless other people were injured but he was not charged with that. I suggest you immediately hire a good lawyer for him, most of us Criminal and DWI lawyers offer a free in office consultation so that is the best place to start. But remember the longer he waits to get good representation the harder it will be to get him a good result.
I was suing my former landlord and use a lawfirm in nyc and case went on for over 4 years and there was a trial . There was no money awarded to either party .
The verbal agreement with my lawyer was that if we collect money he will take a 3rd and if we dont he will get nothing .We recieved no money and now he is suing me for the legal fees .
He has no retainer agreement , it is his word vs mine .
My question is
#1 can he sue me , his client ???
#2 I never got served with the papers untill yesterday regular mail and it is dated 12-21-11 and says I have 20 days to answer , how do I answer this ?

What happens if you divorce and then six months later you pass away and then your ex husband is now telling the family that he has proof that the divorce was revoked by him and the deceased one week before she passed if he claims to have a notorized paper stating that both parties confirmed they wanted to cancel there divorce before there six months was up Would the Ex husband then have legal right to make decisions based on the deceased such as legal action to take what was and had before been decided wasnt his and if there was spousal support to the wife at the time of divorce now that she has passed would the husband be obligated to continue paying spousal support to say the next of living kin? or would the allimony be null and void? The husband is wanting for himself to be listed in the obituaries as the deceaseds husband of ten years when in fact they were divorced six months ago if the family were to do that would that be an upper advantage for the husband and be considered as common law marriage and give him the upper hand to use that in court say if he were going to take someone to court and claim to still be married even if its common law marriage can he claim her as his wife and collect her property that is left behind?

I appeared in court for a disclosure hearing. I was ordered by the judge to pay fifty dollars monthly to the creditor. i do not have this amount to pay. What can I do?
