Why on earth did you wait a year to start asking questions? Honestly, I suspect that wait will prevent you from making any significant changes to what you are doing today. Parents are presumed to act in the best interests of their child, and since you did nothing to complain about his taking the child for this long, the court will very likely say you essentially agreed to it. That he ignored a court order is bad, and that will not look good to the court. But the court is first going to try to maintain stability in the child's situation, and since you let his father keep him for so long, you're going to have a very difficult time changing that. I suggest you sit with an experienced attorney who can get the details and give you advice tailored to your needs.
