I want to file for a simple uncontested divorce in Las Vegas. No shared assets, no kids, no nothing. Married only 4 months. I heard the courts are shut down due to coronavirus, so I'm not sure if the filing for divorce can still take place or not. Thanks in advance.
Yes, the Court is still accepting filings. You can obtain the forms through the Family Court Self Help Center (https://www.familylawselfhelpcenter.org/) or you can retain an attorney to assist in the matter. You will need to either file the documents electronically or send them through the mail which would likely be complicated because of filing fee payments.
Usually, an uncontested matter is resolved within approximately 2 weeks. Due to COVID-19 issues and limited access at the courthouse, I think the process will be 4-6 weeks conservatively.
Uncontested divorces can certainly still take place. No court appearance is necessary to process them anyway.
People can still get divorced, either with or without assistance from an attorney, without having to come in personal contact with anyone.
The Courts are open, but only sort of.
There is a new administrative order that everything with the Court Clerk must be done electronically or by email. http://www.clarkcountycourts.us/res/rules-and-orders/2020-03-21_12_20_37_administrative%20order%2020-10%20eliminate%20paper.pdf
So, the courts are still "open"; however, navigating the process will be more problematic.
