1. I left the motorcycle under my housemate's care.
2. Saw a tow company letterhead (USPS informed service) addressed to me, and called to find out that my motorcycle is with them.
3. It got towed from a completely different neighborhood (stolen), but my housemate didn't inform me when it was missing.
4. I called the police but they could only take in-person report.
5. I'm in a lockdown abroad (SF is in a CoVID-19 lockdown too) & can't leave for the next couple weeks; meanwhile tow company is conducting a lien sale on top of adding towing, storage fees daily (over $2200) at this point.
What am I liable for, what can I do?
I'd appreciate your help more than words could express, running out of ways so I don't run into further debt. Thank you so much, legal community!
I suppose for a legal fee a lawyer could seek to obtain an injunction to stop the sale....it will cost something.
Yes. You are responsible for any deficiency owed to secured lender.
Consider C7 BK to surrender interest and be relieved of liability.
Perhaps you will have a case against your roommate when you return.
