Was hit, the other driver took fault, went through physical therapy for many months, have a lawyer, now it's in the settlement phase, the other party's insurance requested 2 yrs of medical reports, sent that too, now due to corona, my attorney isn't responding but got a letter from his office where it says that the medical clinic where I had the treatments and holds a lien, now released the lien to my attorney. The letter that the clinic sent to my attorney, the attorney sent to me and to MY insurance saying to my insurance to direct my med-pays directly to the attorney. Q: what does this mean in the contexts of a claim and my settlement? That letter that I got was also sent to MY insurance for some reason so aren't they supposed to send it to the opposing insurance? The opposing insurance had my case in an investigation so requested my 2 yrs of medical reports and they wanted a recorded statement...my question is why would my attorney and the medical clinic want my insurance to make med pays since the whole time we are fighting the other at fault insurance?
Since you have already hired an attorney, you need to discuss this with him or her, as he or she is the most knowledgeable about your particular case.
Call the office and set up a time to go over your case in your attorney’s office. Don’t take no for an answer as to scheduling an in-office appointment at the earliest opportunity after the coronavirus scare is over. Or, if you don't want to wait, speak to him or her on the telephone. Most attorneys are still working telephonically during this time. This, after all, is the reason you are paying your attorney. In my opinion, any further statement from me on AVVO would be inappropriate since you are already represented.
If after talking to your attorney, you are not satisfied with the answer your attorney gives you, or if the attorney refuses to meet with you, consult with another attorney in your area to go over any potential legal options you may have regarding this issue. You are free to consult with another attorney and even fire your current attorney if you so desire. Stop second guessing your attorney and discuss your case with your attorney.
I agree with the other responses. Your insurance rates will not increase by using your med-pay. Indeed, it will leave more money in your pocket at the end. Your attorney is representing you very well. Relax.
I agree with the prior answer. Talk to your lawyer but ultimately you should allow them to do the job you hired them to do.
Your med-pay claim has nothing to do with the fault. It is an available coverage and living it on the table is foolish. Your lawyer is doing the right thing. If you have doubts talk to your lawyer.
