Go to the Clerk of Court - Criminal Division to obtain a certified copy of the Judgement of Conviction or a certified copy of the judgment roll showing dismissal of the case.
Then go online to the California Department of Justice website to print out the Application to Obtain copy of State Summary Criminal History Record (Form BCIA 8705, pdf) and follow the instructions on the form. A Spanish version of this form is also available (Form BCIA 8705S, pdf).
Once you have received your Record Review response, if you want to challenge the contents of your criminal record, you must complete the "Claim of Alleged Inaccuracy or Incompleteness" (form BCIA 8706), which will be included with your Record Review response if there is criminal information on your record. Mail the completed form, along with a copy of your criminal history record and the certified documents from the Clerk of Court to the address indicated on the form. Your challenge must specifically state the basis for the claim of inaccuracy or incompleteness and include any available proof or corroboration to substantiate your claim.
Attorney Michael Hayes
if all the cases are in LA I would assume you would do the same as we do in Palm Springs and that is to go to the criminal clerk's window at the courthouse where your case was heard, for a printout of your case......specifically the Minutes of the case.
out here we could get it online but I suspect you may need a certified copy that you would have to get at court.
If by closed you mean settled, each case has a disposition order, that indicates your plea (or verdict) and sentence, you may be able to get the paperwork at any courthouse, but definitely at the courthouse where the case was prosecuted. Regarding open cases, that's what the background check is for.
How does Attorney find at-fault drivers coverage limits?
I was in an accident 1 1/2 years ago - my attorney still doesn't know the at-fault drivers limits. I was out of work four months and have surgery on the horizon. Two part question:
1) How does my attorney find out limits from the other insurance co?
2) How do we know the at-fault driver's carrier will be forthright and honest in reporting limits?
Teenage Son, possible removal.
My teenage son, 15 years old has been in rehab, in- patient, and out patient for almost a year. He was tried for 3rd degree assault, convicted and I had to pay 3,000. cost to ahve the other kids teeth put back in his head. He continues to smoke pot and fail drug tests, which he is on probation still. He continues to smoke pot around our home when we are not there, curse us out you name it. I feel i do not have to put up with this anymore. Me and my wife feel that we are prisoners in our own home with this kid. If he fails another drug tests his probation officer wants to take him back to court and we will have to get an attorney. This is so not fair. I would like to get an attorney for complete removal. What are my options, Help.
