How does Attorney find at-fault drivers coverage limits?

I was in an accident 1 1/2 years ago - my attorney still doesn't know the at-fault drivers limits. I was out of work four months and have surgery on the horizon. Two part question:

1) How does my attorney find out limits from the other insurance co?

2) How do we know the at-fault driver's carrier will be forthright and honest in reporting limits?

1. There are a number of ways to find this out, including private services. Also, your attorney could send a letter to the other party's insurance company requesting this information, but it is generally private and cannot be released without the other person's permission. It is required to be turned over in discovery, as well, after a lawsuit has been filed.

2. You don't know unless you file a lawsuit and get it in discovery.

You should really be having this discussion with your attorney. He or she should be able to answer this for you.
