What is the actual statute explaining "3850"? There is a case where evidence was never presented by the prosecutor and the defense attorney did not demand it.

The answer to your question begins with a search of the Florida Rules of Court, Criminal Procedure Rule 3.850, Motion to Vacate, Set Aside or Correct Sentence. Reading the rule along won't get you very far, so I strongly suggest you contact a criminal appeals lawyer with experience handling these types of motions immediately, as your time to file an appeal is limited.
