I rented an apartment from a landlord that had a lease to purchase contract on a home that had two apartments included on the property. The person I rented from filed personal bankruptcy and walked away from the property before she was served an eviction notice from the owners of the property. Right before she walked away I discovered water infiltration and mold in my apartment. She is now out of the picture and the homeowner has already sent a contractor to evaluate the issue. I have Lupus and can not stay in the apartment until the issue is resolved and the mold is remediated. According to my tenant rights in Virginia alternative housing should be paid for while the work is being completed. So the big question is….who is responsible? The homeowner has inherited three tenants when my landlord walked away. They say that I don’t have a lease with them. I believe I am covered by the Protecting Tenants at For-closure law.
You will probably have to pay for it initially and hope for reimbursement from the owners insurance. The landlord is not an option for payment.
