if a case was heard in a superior court and the proceeding was allowed to follow through this without the ABC license being submitted for in place premise supplied drivers license and also a contempt of discovery order for the insurance policy to be produced ignored while the eleven year litigation was ensuing the property was released to another bar owner that became the first to ever have a license on the property. There was a case that developed to court at the same property address that was finalized before the first that had no ABC license ever issued as latterly found although an insurance company defended the defendants the unlisensed holder of business and the property enterprises that leased said property for use.any response???

Condominium/home owner�s responsibility

I am a plaintiff in pro per. The defendant owns a condominium unit above my unit. His friend flooded his unit and the water overflow caused great damage to my unit. The owner says he never caused the damage. His attorney says his client is not responsible.

I understand that the defendant�s friend is responsible. However, I also believe that the defendant who is the owner of the unit is equally responsible.

Is the owner responsible?

what are grounds for objection, and why object?

I am trying to win my case for which I could not find an attorney. I am a former student whose university has made a lot of mistakes on his transcript, damaging my GPA. I pointed out the mistakes, but they tell me it was my responsibility to tell them about the mistakes before I graduated -- and now we are in court on a petition for ordinary mandate hearing. They filed their opposition brief. They make a lot of clearly erroneous statements, fail to prove facts that could be easily proven if they were true... so I want to object to such stuff in declarations by their ''experts,'' and even in their statement of facts in the brief based on such erroneous statements, hearsay, etc. What are permissible grounds for objection? I know about ''hearsay,'' ''irrelevant,'' and ''no personal knowledge.'' But what about ''clearly erroneous statements'' i.e. just clear mistakes in facts, and ''conclusions of law'' by an expert witness non-attorney (and where most of the conclusions are clearly erroneous statements of law, given stare decisis on such matters)??? Also, what about arguments based on such objectionable expert declarations and evidence? Can arguments be objected to?

Postponing summary judgment date

I am representing myself. The defendant has filed a motion for summary judgment/summary adjudication and the hearing is set for May, 6, 08.

I just received notice of jury duty. I have been scheduled for jury duty the week of May 5, 08. I can not postpone my jury trail again since I had already postponed it once before due to a death in the family. If I file a motion to continue summary judgment, have it served on the defendant by mail, and set a hearing date based on 30 calendar days + 5 days, the hearing to postpone summary judgment will take place after May 6, which is after the motion filled by the defendant.

How can I postpone the summary judgment on May 6, 2008?

Why did the Respondent's attorney object to my argument?

I am fighting with my university, so they will correct mistakes in my academic record, which they say I should have called to their attention before I graduated. They allege a compelling state interest in NOT fixing the mistakes, that they have lots of students to graduate, blah, blah. I pointed out in my opening brief (in the ordinary mandate proceeding) that there is a ''special relationship'' shared between students like me and the university, because we are so totally dependent upon them to get the academic record and GPA right. (There is case law on such ''special relationship'' situations between government employees and ordinary citizens who are ''totally dependent'' on them; Clemente v State of Ca 1980, 101 CalApp 3d 374) Why would the attorney for the university ''object'' to my argument? Why not just argue against my argument in their opposition brief? Is what they did just a lazy way of addressing that argument of mine without going to the trouble of writing an argument out? That is, they are willing to take the risk that the court will NOT agree that a special relationship exists? (Of course, if the court did agree that a special relationship exists, why bother to argue?) What can you tell me?

Calif. Petition for Writ of Ordinary Mandate Reply Brief Length

I am at the stage of my Petition for Ordinary Writ of Mandate proceeding that I need to write a ''reply brief'' for the trial court. The litigation is really quite complicated, and the opponent is either ignorant of the law or is just giving me more to write about and contest. My reply brief is at least 15 pages long. I could not help it, I have so much explaining to do here! Is that too long, 15 pages? And do I need a table of contents and other tables?

Asking for a ruling on matters before a trial?

Can I ask a judge to make a ''ruling'' on certain matters which, depending on how the court views these matters, so that I can argue my case better? For example, there is a matter of what I think is a ''personally important constitutionally protected interest'' at issue. If the judge does not agree then I would be arguing in the wrong way. However, I can't imagine this judge disagreeing with me on this -- but unless I can get a ruling how can I know for sure? Here the Respondent is arguing that I do ''not'' have such an interest in the matter. I would like to know ahead of time what the judge things it is. Can I make an ''ex parte'' motion, or any motion at all to get such a ''ruling'' so that I know where I stand with this judge on this issue? And how soon before trial do I have to make such a ruling motion? ---- Additionally, I would have to say unless the judge agrees that my ''personally important constitutionally protected interests'' are at stake, then I would have to say this judge is making a major mistake because he is bucking stare decisis, and I would have to appeal. But that would also make the trial a real bugger, and I might lose! So is there anything I can do if he does make such a ruling mistake?

Filing an opposition to summary judgement

I am a plaintiff in pro per who have filed a lawsuit against two defendants in a civil case. My condominium unit suffered heavy damages of over $30,000 as a result of lots of water coming into my unit from the unit above. One of the defendant's attorney has filed a motion for summary judgment. He has argued that the owner upstairs whose condo caused the flooding that caused extensive damage to my unit is not responsible for the water damage incident. He has argued that the owner�s girl friend is responsible as it was the girl friend who flooded the unit and caused damages to my unit and not the owner.

I want to file an opposition to the motion of summary judgment. Where can I find supporting arguments to show that the owner is responsible. My discovery shows that the girl friend was allowed to live in the owner�s unit, that the girl friend used the owner�s unit to stage damages against my unit, and the owner should be responsible.

I work for a company that employees college age interns during the summer. We secure their housing and pay their rent for them while they are working for us. We have been told that it is legal to pay them a flat wage (below minimum wage) because their hours fluctuate so much depending on how many kids are at camp each week.
