Would this qualify as a defective summons?

I recently received a summons in new york city for an open container violation. My birthdate is incorrect on the summons, and would actually make me a minor, which I think would mean that I needed to be charged with something other than 10 125 (2b). Additionally, the appearance date listed is for a weekend. I called the court and they said that the summons will likely be deemed defective in processing and dismissed because of the incorrect courtdate unless the officer made a change before submitting it. Also, the officer alluded to me that the information on the summons was incorrect. Is it safe to say that this summons will be dismissed without me even having to appear?

Conflict of interest?

I was represented by an attorney in a case where the board of nursing sought to sanction me. My attorney advised me to surrender my license, otherwise the board could just take it. I was advised that appeals are messy and usually result in further problems to the 'defendant'.

The attorney and her firm represent people whose licenses are jeopardized by regulating boards. That is their specialty. The board knows these lawyers, there is a relationship. I sometimes wonder if I was advised to not make waves, thus allowing the relationships between my attorney and the board to continue without difficulty. If that happened, is that a conflict of interest on my attorney's part?

Taking default

50 days have passed and one of the defendants has ignored responding to my amended complaint. The second defendant�s attorney has responded. I have sued these two defendants for thirty thousand dollars worth of damages.

Through an agency I have done an asset search and the non-complying defendant in pro per does not have more 15 thousand dollars in assets. She also makes $4,000 each month. The second defendant who is represented by an attorney has close to six hundred thousand dollars worth of assets and makes $7,000 each month.

Is it too soon for me to file a motion for default judgment against the defendant who has not responded?

If I take a default against the non-complying defendant and ask for my entire damages (I know she can not afford the entire damages), what happens to the second defendant in terms of paying for my damages?

The father died leaving all assists to the son who is also the executor of the estate. The father put the son on his bank account as a cosigner but he was the primary owner. The son spent all the monies in the account without paying off the credit card bills of about $8,000- There still is a home that is for sale. Can the bank charge the son with fraud for spending the cash?

My child's school is asking that I sign

a document that consents to a

background check before I am

allowed to participate in a field trip. I

have no problem consenting to this.

However, another page of the

document consents to access to my

education, employment history and

financial information. I talked with

the school lawyer and he said I must

sign all the pages in order to

participate in the activity. Can they

require me to consent to the

additional information (more than

just a background check)? Again, I

do consent to the background check.

Sealing or expunging of criminal records

Will a person be able to legally seal or expunge criminal records if; they were charged, arrested and sentenced to prison for a non violence, white colar crime such as charges commonly associated with check fraud ex. Grand theft, uttering forged instrument etc? And what's the average cost?

Car Accident

I was in a car accident a year and a half ago. I got rear ended and hurt my neck really bad. Two months before that i was hit by a drunk driver. He settled the d driver case, but he hasnt done anything on the second one. wont return my calls for the past month. Lied about talking to statefarm, i dont think he has even worked on the second case even though he tells me he has, because his stories dont match up. Should i just go through the guys insurance company, and try and settle by myself and what should i do about my lawyer?

I am 17 years of age. I was at a party and had a beer. I am a law enforcement explorer and I have the ability to ''ride around'' with a police officer that is on duty. I left the party and rode with the officer. The party I went to got busted. Another person told the officer that I had been drinking at the party. The next day, the officer brought me in to ask me if I had any thing to drink before I got in with him and I told him that I did. My question is, Does he have everything he needs to be able to give me a ticket for illegal consumption of alcohol?

Summary judegment

The defendant's attorney has filed a motion for summary judgment with the superior court in California. How long do I have to file and serve an ''Opposition'' to it?

I also plan to file a motion for summary judgment against the defendant. If I do this, do I still need to respond to the defendant's MSJ?

How elaborately I should present facts in my motion of opposition as well as in my motion of summary judgment against the defendant?

I was the manager for a Manufactured Home lot and we had two customers file bankrupcty after we had set the homes on there property and the owner of the bussiness fired me and is going to try to recover his lose from me. Can he do this. The sales Manager did all the paper work.

SBA Disaster Relief Loan

We were involved in the December 2007 Flood in Chehalis WA. We own a piece of land and two homes. A standard home and a mobile home. In May 2006 (after the sale of our condo in So. California) we moved mother to the main home and began updating the Mobile home for her. It was and still is our intention to move our family to Washington once the mobile home was complete. The updating of the mobile home was about 98% complete when the flood hit. The mobile home was and is a complete loss. We sustained about $4,000 in damages to the house. We were told that FEMA would not help us as our home was considered a 2nd home and because Mom was not living in the Mobile home at the time she did not loose any personal property they would not assist either. SBA says that they are denying my request for a loan to �rebuild� the mobile home. They stated that because we can not prove that my mother was living there and because we can not prove that we were in the process of moving to Washington that our claim will be denied. Everything is in MY name. They are not accepting that the mobile home was an extended family home. Can we sue to force them to give usa a loan to rebuild?

Not showing up for deposition

The defendant in pro per did not show up for production of documents today. She has neither mailed me the documents nor called me to request an extension. 30+5 days have already passed. I called the defendant�s cell phone today, her voice mail came up in which she confirmed that it was her. I left her a message. Here are my questions:

1) How many days I should wait to file a motion to compel answers?

2) Can I request for sanctions?

3) When I file the motion to compel answer, do I need to give the defendant 30+5 days to come to the hearing?

4) What will be my next step if the defendant continues not to show up for the hearing?

I live Downtown, and have residential and commercial neighbors.

The adjacent commercial neighbor snowplows his parking lot in the middle of the night.

I tried to talk to the plow driver and property owner to try to get a little consideration. I�m more than willing to be flexible�they just get crazy on me.

My question: Does a Truck with a snowplow attachment constitute �Commercial Power Equipment�?

a. In residential or commercial land use districts between the hours of nine o'clock (9:00) P.M. and seven o'clock (7:00) A.M. the following day, or between the hours of nine o'clock (9:00) P.M. and nine o'clock (9:00) A.M. when the following day is a Sunday or legal holiday,

b. In any land use district if such equipment emits a sound pressure level in excess of eighty two (82) dBA measured at a distance of fifty feet (50') (15 m);

CA Tort Claim

I submitted a CA tort claim with a public school. Before the 45 day response requirement I recieved notice that they were ''considering'' the claim. Im doing this without an attorney. More than a month has passed. Is it appropriate for me to contact them again- I have not heard from them again.
