The district I work for has brought

me up on charges under the 3020a

education law. They claim I lied on

my application regarding my former

teaching position in Pennsylvania 10

years ago. I was also sued in civil

court by a former student who won a

partial verdict(stemming from

allegations over 10 years ago in the

state of PA) There were never any

criminal charges file\d pertaining to

this matter. Other thenh defending

against the charges, do I have any

legal recourse against my school

district at this time?

Can we sue for emotional harm?

My son has an offical diagnosis of Asperger's, is on an IEP and was kicked out of the public school system based on a residency technicality. We believe this was in retaliation for asking for an out of district, placement and for complaint against his teacher. Both of these issues are currently being investigated by the DOE in our state and also by the OCR as we have lodged an official complaint. Both offices have asked us what we want the outcome to be of our complaint . Besides stopping people who discriminate and retaliate can we ask for damages to be awarded for their wrong doing? Can we sue for emotional harm?

condo stairs

we are buying a condo and my husband has Multiple Sclerosis and can not use the exhisting stairs as they are too high..we asked the condo assoc about changing the stairs to make them lower and easier for him to use...they told us that we would be responsible for the cost to replace the stairs...which are outside...is this true...do we have to pay for the stairs outside

I am currently going for my teaching degree in NYS and I am also a substitute teacher. Can NYS randomly drug test me without any probable cause now, or ever, if I become certified? And if they do, can they revoke my teaching certificate?

schools legal rights

Can a school hold a report card of a minor child if the child was given fundraiser cards to sell, if the cards were lost? They want us to pay $120 for the lost cards when were weren't aware they cards were passed out?

termination

I have worked for the same community college for 28 years. I’ve never been written up or disciplined for anything. 6 weeks ago, they put me on paid administrative leave for allegations of inappropriate behavior. The very next day they put me on the administrative leave I met with Human Resources to find out what they were talking about specifically which they could not tell me anything at that time. Finally I was called back after 6 weeks and handed a termination packet with the chance to appeal if I so desire, which I am. I am being terminated for a few incidents where I said I had a doctor’s appointment and didn’t go to it instead I met a friend. They did not know this until they put me on the leave and locked me out of our email system and then went through all of my personal emails. So they are saying I falsified documents and therefore I am being terminated. Is what I did something they can strip me of 28 years of employment with them in which I’ve never been in trouble for anything?

Gifted Child Disruptive in Class

We live in Orange County, and my 8-year-old daughter is in the GATE program. She has always had behavior problems in class. I received a letter today from her teacher indicating that they are creating a formal record of her behavior and having her monitored by others. She is disruptive, but not dangerous. Her schoolwork is top-notch. Her teacher writes that she is ''violating other children's rights to an education and my right to teach.'' I fear that they are trying to remove her from the GATE program. She is highly gifted and this program provides an important and appropriate education for her. Before she entered GATE in 2nd grade, she was bored to death in class and was receiving an education that was well beneath her abilities. Her teachers generally used her to tutor other children -- not, I feel, an appropriate use of what is supposed to be her learning time. I am frightened to death and feel that I should hire an attorney to represent my child's interests. Can you guide me as to what my next steps should be?

is law school really worth it after college? i read that 1 in 6 law students are unemployed after law school and inmajor debt. i really want to be a lawyer but those two thingsare scaring me...please give me some closure and advice thanks.

Picking a child up from school

If both parents have legal custody but only one has physical custody, can the non-custodial parent pick the child up from school? The non-custodial does have visitation rights and there is no type of restraining order in place., but the custodial parent says she should be called first. So if a non-custodial parent came to pick up the child, should the school let the child go with him/her?

Action against State University

The majority of our class was placed on probation for alleged student misconduct. The majority of students have exhausted the appeals process through the University. As part of the probation terms specifically stated in a letter each of signed, we were to specifically ''attend and partially pay for an Ethics class to be held in September, 2007''. The University did not hold this Ethics seminar in September, 2007 and now want to hold it in January, 2008.

1) Can we legally challenge that we signed the document to attend the seminar in September, 2007 and not any other time and therefore not be responsible for attending and partially paying for the Ethics seminar?

2) What court and type of action would we file with to challenge this?

Two questions:

When a Architect Dies, is it true that his plans can be finished under his seal by a unlicensed draftsman or apprentice? (in this case his son with 30 years experience working under the Architect)

Second: It is my understanding that after all such plans are completed that the Architects Seal must be destroyed, is this true, and at what point is this required?

City and School

Hello,

I'm a student at Central Washington University with a question of concern. I recently got a fine for a noise violation at my house here in Ellensburg, which is off campus and shouldn't be affiliated in any way with the school. However, the school knows of this infraction somehow and wants to hold a meeting with me, in which i feel they are going to reprimand me. I already have to pay a fine which is at the maximum cost, for a violation in which the police officer himself said we weren't being too wild and loud, we just needed to keep it quieter (within a 50 foot range). My question is, Regarding the city, are they allowed to release this kind of information to the school without my consent? I have not filled out any sort of release form indicating that this kind of information is to be shared. They've created a hassle for me, because now I have to be punished by two organizations rather than one, for a trivial misdemeanor. Is this fair by law?

Summer Assignments.

When homework is assigned over summer break, why is it just mathematics and reading? Are these two subjucts the most crucial towards our education?

College Refund?

I went to a private college for almost three years and paid about $36,000 or so in tuition with my Student Loans. The college suddenly went bankrupt and closed. I applied to a new college to finish my degree, only to find out 3/4ths of my credits would not be accepted... upon further research I found that the majority of the credits wouldn't be accepted at any of the local schools. But I am still paying for them!

Do I have to pay for nontransferable credits after a school is closed?

Suspension pending hearing for knife possession

My child has been bullied in his class every day for several weeks.. The bulling included pushing and shoving, and punches in the stomach. The last straw was choking in which my chid called me right after the incident to say he was frightened. I had , at first, informed the teacher of what was going on. I also informed her the next day and the day after that. Finally, on the day that the bully put his hands around my son's neck, I called the principal and threatened o call the police and file assault charges. The principal quickly responded , caught the bully and a friend on video surveillance assaulting my child and both received 5 day suspension. After the 5 days, the bully retaliated with demanding to fight my son at a school yard several hours after school. My son's friend, wanting to protect him, went to the school yard to confront the bully and was met with over 30 kids. My son's friend was pounced on by a bigger kid who held him down while the bully attacked him. My son felt threatened and frightened by the unruly mob and took out a pocket knife for defense to back up the kids that were about to attack. The next day, my son received 5 day suspension and a superintendents hearing. Do I need a lwyer?

Counseling an 8 year old at school

In California, The grade school has been sending my 8 year old son to the school counselors office for several weeks now. They have never notified me. I just found out about it today from someone other than the school. Also, after an incident where my son became angry with his teacher and told her he would throw fire crackers in the class room, the police were called and my child interviewed same person told me of this today. Is any of this legal?

Does my conviction violate the California Education Code

Does a conviction of California code 23103 (A)- Wet reckless violate the California Education Code 44237 in any way? If so is there any way to have this expunged since it will be three years in December 2007 since the conviction? Thanks for your help.
