Profoundly Mentally Handicapped Child

My son is in a PMH class in a local public school. He is unable to learn and spends most of his time watching TV at school or lying on a mat. Is there some way I can hire a lawyer to draw up papers stating that I would not hold the DOE responsible for his ''lack of education'' and keep him at home? He is severely physically handicapped and is totally dependent upon me and his dad. We have a Dr. that has put him on ''medical homebound'' but the school is saying that they can override the Dr. and make him come. I appreciate the fact that some handicapped kids are educable and need public school. Also, due to my child is not being educable I am not allowed by law to homeschool. Any info would be appreciated. Thank you.

Academia Stipend Repayment

I withdrew from graduate school on December 6th, and the semester ended December 5th. I received my stipend (direct deposited), as regular, for the entire month of December.

I got an e-mail from the institution's accounting person today stating that I owed money back to the institution because they overpaid me. Unknowingly, I was supposed to be paid a prorated amount for December, instead of the full stipend amount, now they're asking me to repay it.

I feel that I should not have to repay them because it was a clerical error on their behalf. The program director even apologized and said it was ''his fault''. Yet, I am still held responsible.

Do I have legal obligations to repay the amount they requested back?

Withholding report cards

I live in the NYC area. My son attends a private school that is an accredited high school. Does the school have the right to withhold my son's report card because I am behind on tuition payments?

My son got beaten up on the school bus yesterday and I want to know what kind of a lawyer I would need and do I need to get one I have a police report and I did call the school and the bus company and they can't be bothered to call me. So is there anyone here who can help me.

attendance/detentions

Im getting detentions for not attending a class that I dont want, have stopped attending and am failing. I dont want to serve these detentions, Im currently suspended because of that. When I go back to school theyre expecting me to go to these detentions. I need another option going to this class is a waste of time I cant pass it, I dont want it and I dont need it but the suspensions are eating into the grades of my other classes. I just want to finish this year of high school and be done with it all. Theres probably more but im already lost on what to do.

School suggesting that I medicate my child

Can school members, (the principal, school psychologist, counselor, etc.), suggest to me that I put my son on medication for ADHD? The school psychologist told my ex-husband and I, in a meeting yesterday, that my son was at the top percentile of ADHD. There were 6 people from the school at a private staff meeting with us that all suggested that we medicate my son. Is this legal? I also had the feeling that the ''services'' that they now offer would be reduced if I do not comply. I am not planning on having my son medicated, and my ex-husband is actually quite adamant about not putting his son on any medication. I feel as though my son is being discriminated against because I won't comply. Do I have any options? I don't want to take my son out of this district, however, I am also angered by what went on in that meeting.

my child was attending yolo high school. durring the day police were called and my child was hand cuffed and placed in the police car,shortly there after was released by the officer while still on school property. my child then left the school and called me to tell me what happened. my child also told me that one of the office personail to leave,just leave. this was just pior to the police showing up. i picked up my child and went to the school an asked where my child was. their anser was that she had been arrested,whitch was not true. my question is does the school have any legal obligations to know where the students are durring school hours and notify the parrents if the student has left or been taken from the school?

Physical / Emotional Abuse @ H.S.

My child has been assaulted, verbally abused, followed and videotaped by someone in school. I have had it with talking to administrators; they allow this kid to continue without punishment at all. It now appears this kid is pulling others in to also menace, harrass and threaten my child and make false claims against my child in order to keep the trouble ongoing. I am working with advocates and police to file reports. I am wondering about legal help, as this is out of control. My child has broken no school rules or laws. The school is not notifying the in-house officer when laws have been broken. Thank you for any help in this frustrating situation.

Several month ago, I filed a complaint against my employer, Department of Education, for discrimination and retaliation based upon their false allegations of corporal punishment and verbal abuse and adverse actions related to the allegations. However, recently I got into an argument with a student in my class, and said something in heated moment which can be construed as verbal abuse. I like to know that if it is indeed proved to be my wrongdoing in this incident, will it weaken my previously filed complaint to NY State aency?

dogs barking

I have to little yorkies that i guess according to annoymious neighbors (that leave threating notes on my door) that bark alot when I let them out side before I go to work. I live in a small apartment complex which does allow dogs. So my question is what are the time frames which i can let my dogs outside. I don't want this to conflict with laws california may have and i know its annoying when dogs bark but I have no other option but to let them outside. Please help.
