Findings Of Fact Captain Doug's Restaurant is located on Key Largo, Florida, at approximately Mile Marker 99.5. The restaurant does business as a corporation. Douglas W. Newell is the President of the corporation, and the manager of Captain Doug's Restaurant. The restaurant is located on the ocean side of the northbound lane of U.S. Highway 1. The highway is a four-lane divided highway at that location. The median is quite broad. The median serves as a location for numerous busineses and structures, and only a portion of it serves as the highway right-of-way. Mr. Newell maintains a sign advertising Captain Doug's Restaurant just east of the southbound lane of the highway in the median. The sign, which, totals approximately twenty feet in height, has the neon letters "restaurant" on a top section. A bottom section specifies menu items available at the restaurant, and is topped by a flashing arrow which points the direction to the restaurant. The sign is essential to the restaurant's business because otherwise the restaurant would not be visible from the southbound lane of the highway. The flashing arrow on the sign is an integral part of the design of the sign. It does not imply the need or requirement of stopping, or the existence of danger, but it is brighter than other parts of the sign and is likely to be distracting to motorists. The arrow would have the same advertising effects if the lights on it were on, but not flashing, and would not, with a non-flashing configuration, be as distracting to motorists. There are numerous signs located along Highway 1 in the Keys that have flashing parts, but none were observed with the flashing arrow pattern of this sign. The Department of Transportation owns a right-of- way along the southbound lane of U.S. Highway 1 which extends seventy feet from the center line toward the northbound lane. The sign advertising Captain Doug's Restaurant lies totally within this right-of-way. The front of the sign is 46.2 feet from the center and the back post is 57.1 feet from the center.
Findings Of Fact Union Street at its intersection with Jefferson Avenue in Jacksonville, Florida, is also known as US 23 and is a federal-aid primary highway. It is a one-way street for east-bound traffic and is located within the corporate limits of Jacksonville. The proposed sign would be located on the north side of Union Street 20 feet west of the intersection with Jefferson Street and would face west to be viewed by the eastbound traffic on Union Street. Zoning at the proposed location is commercial/industrial. Criterion Advertising Company has been issued permits for two signs near the intersection of Union Street and Jefferson Avenue (Exhibits 5 and 6). These signs are on the south side of a building on the northeast corner of this intersection, thus making them parallel to Union Street 14 feet and 20 feet respectively east of the Jefferson Avenue pavement. Jefferson Avenue is not a federal-aid primary highway. In their inventory the Department of Transportation (DOT) carries the Criterion signs as facing westerly because they can be seen by the eastbound traffic on US 23. There are only four blocks on an application for a sign permit in which to mark the direction in which the sign faces. These are the four cardinal points of the compass. Highways in Florida, as well as the streets in most cities in Florida, run generally in a north/south or east/west direction. Signs alongside a federal-aid primary highway that are intended to be seen by northbound traffic are carried in DOT inventory as southerly facing signs whether they actually face in a southerly compass direction or not. Advertising signs, the face of which are parallel to the highway from which they are viewed, are not as saleable as are signs at right angles, or nearly so, to the highway.
The Issue The central issue in this case is whether Respondent is guilty of the violation alleged in the Notice of Illegal Sign dated September 17, 1987; and, if so, what penalty should be imposed.
Findings Of Fact Based upon the testimony of the witnesses and the documentary evidence received at the hearing, I make the following findings of fact: On September 17, 1987, the Department issued a Notice of Illegal Sign on Right-of-Way for an outdoor sign located in the water and adjacent to U.S. 1 approximately 1.39 miles north of Jewfish Creek Bridge, Monroe County, Florida. The sign in dispute was visible from the road and stated the following: Egan's Waterway Restaurant Gas Good Fast Food. Tourist Info M M 107 1/2 (Right after bridge) The sign did not have a state outdoor advertising permit attached to it. The sign was located approximately 85 feet from the centerline of the road. U.S. 1, also known as State Road 5, is designated as a federal aid primary highway in Dade and Monroe Counties. Egan Adams is manager and president of Egan's Waterway. Mr. Adams admitted he is the owner of the sign in dispute. The sign was mounted on a pontoon-type vessel and was anchored in knee- deep water. The vessel had been registered as a boat and identified by Florida 7454 FG. Prior to issuing the Notice of Illegal Sign, the Department's employee had warned Mr. Adams that the sign was located within the right-of-way. On or about September 19, 1987, Mr. Adams moved the sign further away from the road and removed the orange violation sticker which had been posted on it. The right-of-way in the vicinity of the sign in dispute is 200 feet wide. The centerline of the right-of-way corresponds to the centerline of the road.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the Department of Transportation enter a Final Order assessing a fine of $75.00 against Egan Adams pursuant to Section 479.107, Florida Statutes (1987). The Issue Whether a sign owned by Respondent and located on the northbound side of 27, at 853 U.S. 27 South, Lake Placid, Florida, is located in the road right-of-way, and must be removed.
Findings Of Fact The Florida Department of Transportation (DOT) is the state agency charged with the duty to administer and enforce the provisions of Chapter 479, Florida Statutes, which regulates outdoor advertising structures along the state highway system. U.S. 27 in Highlands County, Florida, is a part of the state highway system, and title to the right-of-way for said highway is held in the name of the State. Respondent is the owner, and maintains a two sided sign structure (sign) located at 853 U.S. Highway 27 South, Lake Placid, Florida, in Highlands County, which has been erected in the DOT right of way of U.S. Highway 27, inventory section 44, approximately 300 feet South on the North bound side of the highway. The sign is approximately 8 foot by 8 foot made of wood with wooden poles, and contains the advertising copy: "Mrs. CLAIR Psychic...Tarot...Palms...(Se habla espanol)", followed by a telephone number. On March 22, 1991, Respondent was served with a Notice of Violation from the DOT concerning said sign, and was advised that said sign was erected in violation of Florida law, and must be removed within ten working days of the notice. Said sign is presently standing in the DOT right-of-way, as of the date of the formal hearing.
Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED that Respondent's request for an exemption from the provisions of Section 479.11(8), Florida Statutes, be DENIED and that Respondent be ordered to remove said sign from the DOT right of way, in accordance with the provisions of Section 479.107, Florida Statutes. The Issue Whether the Respondent is in violation of Chapter 479, F.S., Section 335.13, F.S., Section 339.301 F.S., and the Federal Rules and Regulations appertaining to outdoor advertising on the Federal Aid Highways.
Findings Of Fact The Respondent admitted that it constructed the subject sign located 1,100 feet west of Junction State Road 59 and 110 on the south side of 110. The copy reads "Mid-Continent." The sign height is approximately twelve (12) feet but projects some seventy (70) feet in the air. There is no permit attached to the sign as required by Section 479.07, F.S. Application for a permit was made but after discussion with representatives of the Respondent, it was found that the sign could not be permitted and the application for permit was denied. This sign cannot be called an on-premise sign inasmuch as it is more than a hundred feet from the business operation of the Respondent which is a truck stop although the sign reads merely "Mid-Continent." Respondent admitted that the business known as "The Big Bend Truck Plaza" is part of an operation of "Mid-Continent Inn Truck Stops" and the "Mid- Continent" sign was erected in anticipation of the further development of the area in which the "Big Bend Truck Plaza" is located. The sign, as erected at the date of the hearing, was more than 800 feet from the premise although it is evidently the intention of the parties that a building be erected so that the sign would be within a hundred feet of the sign that is now standing.
Recommendation Remove subject sign within ten (10) days after the issuance of the Final Order unless Respondent removes said sign previous thereto. Findings Of Fact On or about August 11, 1987, a DOT sign inspector observed a portable sign opposite Respondent's place of business advertising Respondent's business and exhibiting Respondent's telephone number, which appeared to be on the right- of-way of U.S. 41 in Pasco County. The right-of-way of U.S. 41 at this location extends fifty feet east and west of the centerline of U.S. 41 and 38 feet from the edge of the paved lane on the east side of U.S. 41. Respondent's sign was located 28 feet from the edge of the northbound lane of U.S. 41, some 10 feet inside the eastern right-of-way line at this location. Respondent has occupied the same building for the past 10 or 11 years and the sign, which is portable, has been in the same location since she opened her salon. No one ever told Respondent that the sign was located on the DOT right-of-way before the sign was cited for the violation. As soon as she was advised the sign was illegal Respondent relocated the sign off the right-of-way.
Findings Of Fact 1. Herman Corn, as Trustee, is the owner of two outdoor advertising signs in Palm Beach County, Florida, which have been cited for violation of Section 479.111(2), Florida Statutes. The first outdoor advertising sign in question is located on the east side of US Highway 441 south of State Road 808 (sign #1). The second outdoor advertising sign in question is located on the south side of State Road 808 east of US Highway 441 (sign #2). George King is an employee of the Department of Transportation with the assigned duty of being an outdoor sign inspector. Fred J. Harper is an employee with the Department of Transportation with the assigned duty of being the District Administrator of Outdoor Advertising. Stephen H. Corn is Vice-President and General Manager of Corn Construction, as well as the manager and part-owner of Boca Tierra. Herman Corn applied for and received permits to erect signs #1 and #2 in their respective locations from Palm Peach County, Florida. George King testified that he cited the signs for violation of Section 479.111(2), Florida Statutes, inasmuch as they were located on federal-aid primary highways and in an area zoned agricultural, and as such were illegal. After his initial inspection, King determined the lands upon which the subject signs are located are zoned agricultural by inspection of the zoning records of Palm Beach County. The Palm Beach County Zoning Maps showing the zoning classification of agricultural for the subject parcels of real property were inspected by George King. Copies of these maps, which were made and certified three weeks before the date of hearing, were received as Exhibit B, pages 1 and 2. Fred Harper testified as to the origin and use of Federal Highway System Maps, which give an up-to-date list of federal-aid primary highways. The maps reflecting the list of federal-aid primary highways were received as Exhibit #1. Harper, utilizing Exhibit #1, testified that State Road 7 is listed on Exhibit #1 as a federal-aid primary highway. Exhibit #1 reflects that State Road 808 is a federal-aid primary highway. Official notice was taken at the hearing of the Agreement established by Section 479.02, Florida Statutes.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law the Hearing Officer recommends that the signs in question be removed. Findings Of Fact The sign here in issue was erected in 1992 and remained in the same location until December 1986. The sign is located along the west side of U.S. 19 in Pasco County, Florida, 41 feet from the western edge of the pavement. The DOT right-of-way at this location is 57 feet. U.S. 19 is part of the state highway system. Respondent stipulated that the sign was located in the DOT right-of-way and was in violation. Upon receipt of the violation notice, the association relocated the sign off of the DOT right-of-way within ten days of the notice of violation (December 11, 1986).
Findings Of Fact American Sign and Indicator Corporation (Respondent or ASI), and owner of the sign involved, has rebuilt a sign on State Road A1A 1.72 miles north of St. Johns County line in the vicinity of the Sheraton Inn and within the city limits of Jacksonville Beach, Florida. The construction resulted in a different type structure and not simply repairs to an existing sign which had previously been permitted by DOT. State Road A1A in the vicinity of this sign is federal-aid primary highway, and the sign requires a permit to be a lawful sign. This sign is a visual display sign with internal lighting to produce the message. The sign's internal lights present the name "Sheraton Inn" and the temperature on the display panel (Exhibit 4). In addition the panel can be programmed to produce any desired combination of letters or numbers, and thereby produce a message. This message can be displayed in the fixed mode or in a traveling mode. Since the matrix of lights comprising the message section is computer controlled, the various types of presentations can be programmed for the desired message and mode of presentation by sequencing the times the lights come on and go off. Prior to rebuilding this sign Respondent obtained a building permit from the City of Jacksonville Beach. At this time Respondent was unaware that a DOT-issued permit for this sign was also required.
