benefits and inheritance

My sister died, there's only my father, brother and me. My father wants us to recieve everything by somehow signing his rights away, so we can avoid him receiving the money, turning around gifting it to us and having us worry about taxes over the amount that is untaxable. She has both a work benefit and private savings acount. Both her work (Federal retirement) and bank seem to think he has to be the one to receive the money.Any ideas?

Your father can disclaim any rights to receive money or property from your sister's estate.

However, by doing so, it is likely that you would have to file a probate. Depending upon your father's tax situation he may not want to deal with receipt of the property/money.

You would then have to obtain a written disclaimer from your father and proceed with the probate.

I recommend that you consult with a local attorney. The probate would be located where your sister resided.
