Civil Suit
I want to know if I can file a civil suit for someone deprieving me of property. Someone has been found with a firearm that was stolen out of my truck. The burglary took place in july of '07. I have been without my concealed carry gun for almost 8 months. I cant pick it up from the police department until the case is over. Can I go buy a new one and sue in small claims for the amount plus compensation for being deprieved of my original?

You have a claim for lost use. That does not mean you can go buy a new gun. Generally speaking, people who rob others' property rarely have funds or assets to pay an adverse judgment.
