I provide HR services to small businesses in PA. Several of my clients have asked that I prepare handbooks and policies. If I purchase an off-the-shelf policy software, is it illegal to create the policies using the software then sell those policies to my clients?

Potentially. What does it say in the license agreement for the software? My guess is it probably restricts your right to do what you want to do. Is the software intended for use by HR professionals in creating and reselling policy manuals or is it intended to be purchased by companies to develop an in-house policy manual.

E.g., there are many estate planning form generators which attorneys purchase (and pay license fees) to aid in the generation of simple wills, revocable trusts and powers of attorney. These licenses contemplate that an attorney using them will be resellling the end product to a client.

Read the license agreement - it more than likely will give you your answer.
