I am a veterinarian in a busy ER and I am scheduled for 12+ hour shifts. I am having a total hip replacement on 1/4. I had a fusion of L4-L5 and L5-S1 last year but have been working full-time since 1/18. I am badly limping and using a cane. My surgeon fears that if I maintain walking like this I will endanger the back surgery. He has written a work restriction for a maximum 6-8 hour shift, but my employer will NOT honor it and threatens legal action if I reduce the length of my work day.
There are a lot of questions that need to be answered. How many employees work there or within 75 miles. You may be covered by the Federal Americans with Disabilities Act and/or the Pennsylvania Human Relations Act. You may be covered by the FMLA if this is a very large operation and there are 50 or more employees within 75 miles.
Have no idea what type of legal action they could take. What does your employment contract contain.
