That depends on the circumstances of the situation and the location of the injury. Statutes of limiation are usually state-specific (i.e. each state has its own rules). Statutes of limitations are also sometimes tolled (or extended) for various reasons including (i) inability to discover the harm (usually in fraud), or (ii) the person being incompetent. In the elder law area, the criticial statutes range from 1 or 2 years (for personal injuries) to 3 years (for financial frauds) and sometimes there are claims that allow for a longer statute. In addition, if a governmental agency is involved the statute is shortened. If you have a concern, you should contact an attorney as soon as possible.
