Immigration law
Can a person be given a court hearing without notice and not be allowed time to get a lawyer to represent him or her?
Doesn't everyone charged with something have a right to a lawyer?
Re: Immigration law
I presume you are discussing a hearing before an immigration court, yes? You cannot have a hearing until you are served with a notice and the notice is served on the court. What that means is this: the government must serve you with a notice at the last address is has for you on file. If it serves that notice anywhere else, or does not serve it, then you can argue you ever received the notice of the hearing. All Immigration Judges are aware that a person in their court has the right to obtain a lawyer at his or her own cost. Usually, and immigration judge will give you a few weeks to find a lawyer. Keep a record of the lawyers you call who do not want your case because it is not easy to obtain a lawyer to handle litigation in immigration court. If you have having problems with a hearing, and you feel you need some help sorting out what is going on, call my office for a consultation and maybe I can help. Good luck and take care.
