I have been with my company for 6 months now and Im having a baby in July. So Ill have been with them 10 months. I do not qualify for FMLA since I have not been there 12 months. If I have a DR. note can thay ask me to resign my position? They cant even garentee me my job babk.

Yes, they can and and with impunity unless you're eligible for protection under other pregnancy-leave laws that would afford some protection that you're not currently eligible for under FMLA.
